Best advice is to start a FBI records check. There are instructions on the FBI website on how to order it. You need fingerprints done (1 card) and I believe it costs 18.00 or so. If he has anything on his records it will show there along with case numbers, country that it occurred in, state, everything. Problem is it takes about 14-16 weeks to get the report. Their are background check places that can order it on your behalf for an exorbitant fee usually. They have a list of authorized places on the FBI website also. You need to get a finger print card done anyway, and since you are in the office have them submit it. If you need any help, let me know, I can send you some links. It is really easy, one page form, money order, and the fingerprint card. I run my records every January 1st or so, and get results in April. I just do it to keep tabs on my records due to my employment, something comes up by mistake, I will be in federal prison for real. Best bet is to push the clerk or courts for it. Another option is they have those places that will expunge your record for a fee, they usually have a good relationship with clerk of courts and can come up with paperwork for a fee of course. Hopefully you get it worked out.

Nothing with USCIS is as casual as calling to explain something.  Everything must be done in writing with as much supporting documentation as is available.

Records are there even when expunged they still have them. The general public will never see them again but the government never gets rid of them completely.

 

Sometimes the clerk at the court house does not want to dig for them so they will tell a person that there is nothing. Many times it's because they are old and not in the computer system and the person has to manually look for them in logs. They need as much info as possible to search in the logs, then they can request them. Most of the time they are kept in a warehouse somewhere so they need to go dig them out. 

 

Good luck with your journey, I'm sure this hiccup will be over soon.
