Timeline
We sent in the EAD today and plan on sending in AOS in about a month or so.

Can you send in EAD without AOS at the same time? I heard you can do AOS... then later EAD, but not the other way around?

K-3 is a different case than a K-1, K-1 can file for EAD before AOS but it will only be valid for the 90 days of the I-94. K-3 on the other hand would get a 1 year EAD because the K-3 visa is multi entry one with 2 year life to it. In theory a K-3 could file for EAD, and hold on AOS until after 2nd wedding anniversary, to avoid having to file to remove conditions, filing the AOS after 2nd wedding anniversary will result in 10 year permanent card.

So before the new fees a K-3 could EAD, get SSN using EAD, and then AOS for the 10 year card.

Right now AOS is $395; EAD is $180 so even though AOS would include EAD it's still $435 more. Maybe $435 is not much for some of you but for us it's quite a bit. It's worth filing earlier than planned IMO.

The new AOS fee includes the EAD as well as AP and eliminates the requirement to pay renewal fees while AOS is pending.

I'm sorry I looked at the USCIS site and here and I must be missing it somewhere....if you are going to file AOS after July 30 then the EAD is included in that $1010?

And holy #######! We may have to rethink that waiting to apply thing. We were going to wait until September so that P has time to finish his thesis, but yikes! That's a lot of extra money for us....

AP is not desired for us plus we wouldn't have to file any EAD renewals.

Question about AOS and the 2 yr anniversary...do you have to be married 2 yrs before filing for AOS or married 2 yrs before AOS is granted to get the 10 yr green card?

It's 2 years of marriage on the day the AOS is approved.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

It doesn't matter; it's included. They undoubtedly "ran the numbers" and saw that most apply for both so bundled them together, regardless of what the minority would desire.

What's the source for your information on the EAD and AP being included on the AOS? I trust you, but theres nothing on this form that indicates that this is true, and I would like to see for myself. Thanks :)

It's at the bottom of page two on the new USCIS Fee Schedule pdf.

Adjustment applications and ancillary benefits – The new application fee for an I-485 is a package fee that includes associated EAD and advance parole applications. Thus, if you file an I-485 with the fee listed above, while you will still need to submit applications for an EAD and advance parole, you will not need to pay a separate fee so long as your adjustment application is pending. However, if you filed your I-485 before this fee change, to apply for or renew your EAD or advance parole, you must file a new application with the new fee for those applications.

We are greatly affected by the increase of fees. For one, I and my child will be traveling together so this means, we have to AOS together too ($1,010 x 2!!!..correct me if I am wrong). On the other hand, if we have to pursue CR-1 now, we were not able to send my child's I-130 same time as mine because we are planning of sending it along with our AOS package. Worst case, I can not tag her along. :crying:

We are greatly affected by the increase of fees. For one, I and my child will be traveling together so this means, we have to AOS together too ($1,010 x 2!!!..correct me if I am wrong). On the other hand, if we have to pursue CR-1 now, we were not able to send my child's I-130 same time as mine because we are planning of sending it along with our AOS package. Worst case, I can not tag her along. :crying:

if your child is under 14 and AOS same time as you, the fee for your child would be $600.

hope you'll be able to go K-3 so your child can have K-4. I know how hard it would be to leave your child behind.
