FOIA or reapply straightaway with possible mismatch of information

Hello 

 

I am filling DS-160 for my parents. Their previous B1-B2 application was filled by family friend who is no more. I don't know what is the date he filled in for my father's employment.

My parents don't have access to the previous application though they were granted the visa.

 

My father has a family business and he has been working from young age, so i am not sure what the exact year was filled in the application.

 

Should i file an FOIA to get previous information or just fill the year when he graduated from college. ( he is over 60 years old).

 

Any suggestion is appreciated. Thanks

01/09/2019  Mailed ROC package via FEDEX to Lewisville,Texas

 01/11/2019  Package delivered to USCIS office

01/16/2019  Received text message with service center as SRC

01/17/2019  Status on https://myaccount.uscis.dhs.gov/ as accepted. Check submitted electronically to my bank. Not cashed yet.

01/18/2019  Check cashed electronically. 

02/07/2019  Called USCIS regarding non delivery of receipt . They asked me to call back after 30 days have expired since delivery

02/11/2019  Called USCIS again regarding non delivery of receipt. Mentioned that license will expire along with greencard on 02/28.

                        The lady filed a request on my behalf so i could schedule infopass.

                        I separately also filed e-request(https://egov.uscis.gov/e-request/displayNDNForm.do?entryPoint=init&sroPageType=ndn

                        by choosing I-751 and other option , before calling USCIS just in case.

02/13/2019 Got callback from USCIS that infopass cannot be scheduled,but they will mail

                       a duplicate notice.

11/08/2019 Biometrics got completed

03/24/2020 Case status got changed to card being produced

I get that but like i said , it is not cut and dry. 

 

I wanted to get input from people who have applied tourist visa in case of paperwork ambivalence for older people and if they faced any issues due to this. 

 

I don't want to falsify information, just want to cover all bases.

That's a very odd way of looking at it. It's really simple - ask him the questions and fill in with the answers he gives. Really simple.

I completely get what you are saying. My father does not remember the exact year.

 

For education and all also he had to look his degree for his exact year of graduation.

 

But how do you establish the exact year of working in family business if you have been working from late teens?

 

I guess i will go with after the year he graduated.  

 

I just don't want his visa to be denied due to the years being different by a year or two.

On the contrary, it is cut and dried. You answer (on your father’s behalf, who signs and takes responsibility for the answers, just like he did when the other relative did it) with the truth. Why would you even think that doubling down on possibly incorrect information is the way to go? Knowingly providing false information on a visa application form is misrepresentation and can get you banned - that’s cut and dried, too.  If your father gets denied, it won’t be because a work date was a year or two out from decades ago.

Your last line is exactly what i was trying to ask about.

We will give our best estimate. that is all we can do at this stage.

Applying after having a visa for 10 years is unlikely to lead to a visa denial for the above reason if they didn't abuse/misuse the previous visa. 

 

Country matters too. What embassy are they applying at?
