I agree - my relative did same, he filed as single instead of married.  It is wrong but not a big problem for the tax purpose and IRS does not pay too much attention: filing single has tendency to own more tax liability. IRS imports a penalty when a filer, in fact, would need to pay more than he/she paid. Generally speaking, it is IRS issue, not NVC/consulate issue.
