I'm a newbie to the site but I've had our application in since 4/4/07 for the K-1. We unfortunately just received an email from USCIS that they have sent a RFE out yesterday. Should I be worried? I checked, triple checked the packet before I sent it..........even went over my copies last night to make sure I dotted every 'i' and crossed every 't' but couldn't find anything that would cause them to send an RFE. It is really bothering me and I'm so glad that my fiance is so optimistic. I'm also wondering if those who have fiances in Nigeria get RFE's more than other countries? I just hope this doesn't further delay the process. Whatever they want I will immediately send out to them express/certified mail.

Thanks in adavance for any helpful suggestions and encouragement

Do not worry, maybe the RFE is to send more proof of your relationship....it sucks but it happens :thumbs:

06/29/2007 Applied for SSN at the local Office

07/07/2007 Green Card arrived

07/09/2007 Another 2 Welcome Letters from USCIS...God, they really love me! :D

An RFE at the petition stage ussualy has nothing to do with the country your fiance is from. You will just have to wait until you get the RFE in the mail, and just satify and send it back right away. It shouldnt delay your petition processing more than a couple weeks.

Also, the RFE could be some document that you already included in your original petition but was somehow misplaced by USCIS or the adjudicating officer just can't locate it among the pile of papers in front of him/her. USCIS is been known to request for same document that was originally sent along with applications. Don't stress yourself unnecessary... just wait until you see what is been requested on the RFE. Wishing you a speedy approval.

What is it that the REF said? What do they wantso we can understand about REF more.

It's called an RFE... and the OP doesn't know what it's asking for yet - they've just received an email telling them that an RFE has been sent out, but won't actually know what's required until they receive it! :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Thank you everyone for your encouragement and advice. I'm really trying to be patient. I have already made another copy of what I sent and now just waiting for the RFE to come in the mail. Hopefully that doesn't take a month like they tell you on the phone.

The RFE is just a sheet sent with the cover letter. It will ask the petitioner to provide additional evidence. Depending on which sheet was mailed will indicate the evidence USCIS is requesting. She won't know the specifics until it's received. Mine took a week to arrive in the mail.

It's discouraging to receive an RFE, but it's also straightforward. Good luck to everyone with a "pending" status!

Making another copy of what you sent originally is a little precipitous. What's that going to do exactly? You don't know which part of the submittal requires additional evidence.

Simply re-sending what you sent the first time won't satisfy the RFE, right? As something in the original submittal prompted the RFE in the first place. Hang tight. Wait for the RFE and then put together another package when you learn what's needed.

My fiance lives in the UK, but he is Nigerian. We didn't receive any RFEs, but I think that is because I was totally OCD whenever we went somewhere. I saved dated pictures, hotel bills, plane tickets, flight itinerary's, bus passes, train tickets. I will say though, that the embassy did do "extra" clearances on him and kept his Nigerian police report. Most people got their visas back in London in 2-3 days, where his took 2 weeks. He told me that they only made a copy of his UK police report, but kept his Nigerian police report. Go figure. :whistle:

if making copies makes you feel better...copy away. But there really isn't anyway to know what they are going to ask for. But you'll need to send a complete copy of the paket to the foreign fiance for the interview anyway.

I agree that it is rarely country specific. sometimes the USCIS asks for random things...but on the bright side. I often see the situation where an RFE was issued and within a couple weeks of the information being submitted back to the center, an NOA2 is issued.

It's good to know someone is dealing with your case and going through it for completeness.

I agree, but it also tells you that they're actually working on your case. Hope you'll get it in the mail so you can send back whatever they're asking from you. I've seen others got RFE and after complying to it, they got the NOA2 in two weeks (or so) time.
