Income Tax return

I'm jobless since feb 2018. My old employer sent me w2 form. i'm going to file taxes? will it create a problem if i file ? Because my petition is at USCIS and IK i will need a joint sponsor as i'm currently jobless. can i still write letter at Nvc stage that i didn't file the income tax return cause of low income if i file the taxes? i'm confused is it better not to file taxes?

You worked for a month in 2018 therefore you had an income. File taxes.

Technically you don't have to file taxes if your income was under 12,000 for the entire year.

You should though, but you aren't legally required too.

And yes, you can write a letter stating you did not file taxes because you were not legally required to due to low income. I wrote a letter like this for both K-1 and when doing the I-864 for my husband to explain a missing tax return.


Question though: Are you the USC or the foreign spouse? I can't seem to find a straight answer looking at prior posts.

I don’t see a question there unless you are asking if your father can claim you on taxes. That I’m not sure about.

 

make sure you have a sponsor that makes enough money per year. The sponsor has to make enough to cover their house hold (themselves, the incoming foreign family member, and any depedants). 

 

I personally wouldn’t recommend being considered a dependent on your fathers taxes. The consular officer will take the totality of your financial situation into consideration, even if you have a cosponsor, for getting your fiancé their visa.

 

its hard to honestly say that you are willing to take the financial responsibility to take care of an intending immigrant when you’re recently considered a dependent on your fathers taxes.

I filed petition for my spouse. Can i use my paystubs of two or three months instead of joint sponsor to sponsor my spouse?

You can and you would need a statement from your employer stating if the job is permanent. But again, they can take your entire financial situation into consideration, they may not consider three months of working after a year or more of not working, not enough proof of support.

 

there have been people who have made enough but had a shaky financial past and were asked for joint sponsors.

 

to sponsor your husband you have to make at least 20575$ a year if neither of you have children or dependents. 

 

This would be making at least 10.75$ an hour and work 40 hours every week for an entire year. Less hours or less pay won’t be enough to sponsor.
