Hello everyone, 

I'm hoping that I can get some clarity on what I need to do before we can schedule for my fiance's interview. I recently lost my job that I originally put on our I129F petition but, I'm still working my part time jobs.  Which combined, I'm just a few hundreds short what's required that would put me just above income poverty level. I do have a joint sponsor but my question is should I still fill out the I134 form since I'm still somewhat employed or do I need to fill out the I864A form and my joint sponser fill out the I864 form?  My fiance's interview will be held in Ghana. Thank everyone in advance for your responses.

My understanding as petitioner, you always have  to fill out one, then co-sponsor does one for themselves.

the affidavit of support is for the interview, so your current situation is what matters now. you must fill out an i134 

 

your joint sponsor will fill out another i134

 

the i864 is the affidavit of support is for the adjustment of status process, once your fiancé is here and you have married, you will file the i864

you will fill out the i134 for the k1. the i864 is for AOS

 

you fill out these forms regardless of whether or not you have a co sponsor

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1
