Timeline

Well, I am happy to say that I have finally reach my decision. I am in the process of filing for a divorce. My husband is from Jamaica and i total fell used he has a soon to be 7 year old who give me no respect and it has became a problem in our home. Its so serious where child service is involved. I am tired and now she has taken the cake and he is doing something that is suspicious and I am not comfortable. I have done so much for them and I feel like I have been stabbed in the back.  

he is suppose to have shown proof of Bonifide marriage by march as of 2019 and he does not have anything prepared. It's like he is waiting on me to do everything and I refuse. But now he isn't speaking to me because of his child. She has lied on me and it pisses me off because I am the wife and and I feel like a maid. I am the only mom she know and she treat me like at 7. He doesn't have my back at all. He lazy does not clean up after himself. His car ain't been clean in a year. He barely flush the toilet he don't clean tub after himself and he says all I do is argue. I don't love him anymore. He has called child service on me for no reason. I just cant believe the things he has done to me. 

 

So his visa expires in June and he is suppose to show proof of marriage and we have nothing but a care note together. No picture, No bills, No nothing he acts as if he does not care. So why should I.

First of all sad to hear this, but with this behavior I wouldnt want to have a husband like this either.

Since his visa is expiring and he doesnt have real proof of a bonafide relationship he has to go back to his country. I think he could file for a divorce waiver, but he would need to proof that he entered this relationship in good faith, which is hard for him if he already struggles with showing proof for the bonafide relationship.

 

Like I honestly never understand this grudge to make it impossible for the spouse to stay in the country. Its like sending nudes of an ex partner but in an immigration relationship it means: ILL GET YOU DEPORTED lmao. If i was you I would divorce and just not help him with anything immigration related

 

Only thing i dont know is, how it is with being financally responsible for him even if he is out of status?

  • Birth certificate(s) of child(ren) born to the marriage.
  • Lease or mortgage contracts showing joint occupancy and/or ownership of your communal residence.
  • Financial records showing joint ownership of assets and joint responsibility for liabilities, such as:
    • joint savings and checking accounts with transaction history
    • joint credit card statements
    • insurance policies that show the other spouse as the beneficiary
    • joint Federal and State tax returns
    • joint utility bills
    • title of car showing joint ownership
    • other joint loans
  • Any other documents that you consider relevant to establish that your marriage was not entered for the purpose of evading U.S. immigration laws.
  • Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. Learn How to Write an I-751 Affidavit.
  • 10-20 photographs of married couple together. Examples could include wedding photos, traveling, special events with family and friends, etc. (You should also hand write the place, names and dates on the back of photos.)

Above all, financial and insurance records can be some of the strongest evidence that you have a bona fide marriage. Sharing ownership of assets and responsibility for financial obligations is a good indicator that a couple plans to remain together and build a life.
