Visiting with an approved I-130

Hello,

I hope that you can help me.

I am French, living in Germany and I am married to a US citizen who lives in NY.

We filled the I-130 and it has been approved in April 2018. We did not do anyhting since then, because I do not plan to move there right away.

However I plan to visit him over Christmas and NYE for about 10 days. I have a well paid job in Germany (I earn more than my husband) and I will be on an ESTA.

Will I have any problem at the border? I plan to show them my return tickets, the flights that my husband will book to visit me in 2019, as well as my paychecks, my work contracts and the proofs that I took the days off when I will be in NY.

I read so many different things online that I don't know what to think or believe anymore.

Hi Julie. When my hubby visited me for omy birthday, he had no issue at the border control. We were in the process of i130 as well. As long as there is a return ticket, it’s fine I think. He prepared his pay checks to show strong ties to his country (Chile), but it was not asked. The only think they asked for was his return ticket.

The only ones that are guaranteed entry are USC, just make sure you have with you strong evidence you will return to your country and you should be fine, however no one here can tell you that you will get into the country sorry.
