Expidite EAD after application

Hey,

 

Once we get married we are going to apply for AOS, and simultaneously choose to do AP and EAD applications. My question is can you update the EAD and get it expedited if you recieve a job offer? 

 

I work for an American company currently but obviously have to resign in UK due to k1 visa rules. They probably won’t have any open roles for a while, but if they did and they offer me one can I update the existing EAD application to get it expedited?

Once you file for AOS + EAD + AP, you can request an expedite based on a firm job offer. No guarantee on approval (but it isn't uncommon) or how long it will take (many people seem to be asking for expedites on the EAD). The normal timeline is ~4-6 months right now, but expedites could be in weeks to a few months in most approved cases.

Personally I would at least wait until you complete the biometrics as they cannot adjudicate the I-765 before then.

They will send you an appointment letter with a location/date/time, usually within a week or two of the NOA1.

Some ASCs (where they take the biometrics) will let you do a walk-in early (you need the appointment letter still). Others only accept you on the scheduled date/time. Call ahead if you aren't sure and want to do it early.

usually it's around 2-4 weeks after NOA-1 for AOS, EAD and AP that you get biometrics done. Some have had walk-ins and speed up that also, but not all fingerprint centers accept walk-ins and like ours, they get irritated if you try to sit inside and you are the petitioner or someone that is not related to the case. We where told to wait outside of the office till 5 min before the schedule. It's small and it's USCIS, so we did as told.

 

TIP: go for SS# as soon as you can after POE, before getting married.
