Tax Forms I Need To Provide?

Hey! My fiancée is getting ready to schedule her interview at the embassy and we saw that they want to see my W2 forms. Only thing is, I’m self employed and don’t have W2’s. In my I-129F application, I explained that and included my previous years tax returns as well as invoices and bank statements to show my income, but none of that comes from employers. What forms do we need to provide?

You are required to complete Form I-134. If the income reported on this form or your tax return reflects income below the poverty guidelines for the year the form was submitted, submit evidence of your income. This can include the following documents: 
    • For those who are employed by an individual or company, submit a photocopy of an employment letter, pay stub, or pay advance (direct-deposit receipt) that meets the criteria below: 
        ○ Includes your name and the company’s name; 
        ○ Is on signed, business letterhead (you cannot sign the letter yourself); and 
        ○ Is issued within the last three months. 
    • For those who are self-employed, obtain a photocopy of one of the following: 
        ○ Your business license. 
        ○ A signed letter on business letterhead that was written within in the last three months. 
        ○ A contract between you as an independent contractor and a company. 
    • For those who are unemployed or retired, submit a photocopy of ongoing income from other means, such as: 
        ○ retirement benefits; 
        ○ other household members' income; or 
        ○ other significant assets. 
          
EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form K1/K2 Interview Preparation Instructions – English (February 2014)  Page 3 of 9 with an original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Financial information is not required to be included in the I-129f.  They may not even look at them since they are not part of the petition package.  They will want to see the latest ITR with all schedules and forms.  Any 1099s included in that would just be part of the tax return.  They do occasionally ask for some additional transcripts.  It isn't a bad idea to download the three previous transcripts just in case.  Tell her not to volunteer them.  Give her bank statements and anything you have that will show them that you meet the requirements AND that will allow them to decide that your wife will most likely not be a public charge.

1) The I-134 and other financial evidence is not reviewed with the I-129F. Not sure where it was suggested to send it beforehand. Anything you did send may be considered outdated by the time of approval, so be sure to have an updated I-134 sent for the interview.

2) Fora self-employed individual, your income will come fro line 22 on the 1040. You will need to provide at least the most recent year's tax return as evidence of the income. Providing the other 2 years is not strictly required, but not unusual to be requested for self-employed individuals.

3) The use of assets is optional if income is sufficient.
