If my fiancé is in the US at this moment, but is about to leave in a few days, and we are putting all kinds of proof of him and I together with boarding passes etc in the packet, would we be required to answer the question 38.a. “If your beneficiary is in the US...” 

“He or she last entered as...” 

if he won’t be here for the final filing of the form?

Don't over think of think this... If they won't be in the US during the final time of sending it, then think about it.... Just because they won't be in the US 'present' at the time of officially sending the petition, you can still enter the information if you want to such as date of arrival/departure and I-94 record number and all in that section. Up to you.  Neither way will cause you issues.

 

Again, I stress this, do no over think this all.

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview
