I have concurrently submitted I-130, and I-485, but I am confused as to how the process works (PD June, 2018). Approve I-130 first then I-485? which timeline should I follow?

 

I've done my biometrics and nothing has changed ever since. I spoke with a Tier 2 officer, and from the conversation I was able to deduce that my I-485 will be at NBC "until my field office is ready to take more cases". So I am thinking my application is just sitting at NBC and not even getting processed. They told me the processing time for my field office is now 10-23 months, which is a huge range of estimates, but it is currently not even assigned to a local office, so I guess my clock has not even started.

Additionally, wouldn't I-130 have to be approved first in order for my 485 to be processed? I don't even know where our I-130 is, (I'm thinking the same situation, not being processed) but according to my state's jurisdiction, it should be Nebraska service center. But again, I don't now which timeline to follow..Anybody has any ideas?

It's gonna be a long wait. Average processing time is a year. It varies due to differences in local field office times. But expect to be done next year.

 

With adjustment of status, the I-130 and I-485 get adjudicated together at the interview. Your entire application sits at the NBC until your interview is scheduled. Only after that does it get transferred to your local field office. The state service centers take care of other things. They don't adjudicate AoS cases.

 

Also, your clock has started. It starts when they receive it and send you the first receipt notices.

As a spouse, under-21 child, or parent of a USC, you fall into the immediate relative category and are permitted to concurrently file the I-130 + I-485. It is true that the I-130 needs to be approved in order for the I-485 to be approved, but they adjudicate them together when you concurrently file.

Non-immediate relative categories (i.e. any with an LPR petitioner, or 21+ son/daughter) must have their PD current before they can file for AOS (concurrently or sequentially).

Thank you. It is a relief that my clock has started. So if my field office now has a wait time of 10-23 months for I-485, then I have to wait for that long for both of my I-130 and I-485 until interview, yes? I was just confused because when I searched for I-130 processing time, it only gave me 5 service centers.

Thank you. every time I check the processing time, it gets longer and longer. It is so frustrating! So I just wait, and don't bother tier 2 officer no more? lol

Until your case is outside normal processing timelines for your local office, there's nothing to do but wait. They will take as long as they take.

Yup. I-485 is what you want to look at if you want to see processing times because I-485 is specifically for AoS. As geowrian explained above, I-130's are used in other immigration processes (petitioning parents and/or siblings, green holders bringing their spouses, etc) and a lot of I-130's are for people outside of the US. That's what I meant when I said the state service centers cover other things. In your case, you're doing AoS (because you are already inside the US), which is only NBC and then your local field office. 

 

Anyways, as far as processing times go, all field offices have a broad range and it has more to do with likelihood and probability than anything. Cases that get finished fast and cases that take a very long time are the exceptions. There are not too many of them. MOST cases get finished within a narrow range of time (my guess is 12-16ish months but this is ONLY my personal guess...this is not a scientifically proven statistic). Your case is LIKELY to be done within that 12-16ish month range. Your case is UNLIKELY to be finished sooner or later than that. All you can do is wait though. There is no way to predict exactly when it will be done.

I came up with another question (sorry). When I applied 3 months ago, thew processing time of my field office was merely 5-7 months. After a while, the wait time slowly climbed up to 2 years. Should I always follow the current processing time? Or should I expect the processing time at the time of filing? I know it is not absolutely accurate, but I just wanted to confirm. I don't know what causes such delay in processing!

They will go by current processing timelines, not the timelines when you filed.

Lots of things affect the processing times. As applicants and petitioners, we don't get to know why. The times on the USCIS change a lot btw, so take it with a grain of salt. Mine jumped around quite a lot. It's gone back and forth between "8-23 months", "4.5-22 months", "12-24 months". You get the idea.

Just for the record, you can't get an exact timeline for your application. Whoever that's assigned to review your case and to interview you may process things differently at a different speed. That's why the timeline is always an estimate. But if your priority date is earlier than the "receipt date for a case inquiry', you should do something to speed it up.

 

To understand the processing time, you can refer to the article from USCIS. In the article, the pilot forms are N-400, I-90, I-485, and I-751.

Using the I-485 form processing time in LA as an example.

The time frame 12-25.5 months are estimating that 50% of the applications will be done in a year, and 93% of the applications will be done in 25.5 months.

 

If you look at the Estimated time range for Employment-based and Family-based applications, you can use the same logic to interpret them. I don't know how USCIS comes up with the 12-25.5 months time frame if both categories have shorter estimated time ranges than that number.  But anyhow that's how we're supposed to read the numbers.

Your priority date will be the time you started your clock unless you receive RFE or RFIE.
