I-485, I-130, I-765 received by USCIS on 6/27, biometrics done on 7/24.  Currently no changes on any of the forms.

 

I have a TN that expires 11/21, so in just under 3 months.  I was planning to wait until the 90 days are up to expedite, so end of September, but I'm worried about getting an RFE in the meantime and delaying the entire process.  Is it worthwhile to apply to expedite my EAD now?

 

The expedite reason is 'severe financial loss to person'.  I am currently employed and my USC husband recently started his own business, so I pay the majority of our bills.  I can get a letter from my employer stating that they will not be able to continue to employ me after my TN status expires in November, and I can send pay stubs, W-2s, and various copies of bills.  I'm guessing that's all I can really provide in this situation.  If it helps, I can ask my employer to specify that I am an integral resource to the projects I'm working on and losing me would negatively affect the performance of our company in relation to our contracts with other clients.  I don't know if that matters though.

 

Should I wait until the 90 days are up (and possibly even get my EAD in the meantime), or should I go ahead and ask to expedite?  Could it hurt?

No reason to wait. USCIS does not adjudicate AoS-based EADs within 90 days. It takes more like 4 months (if you are lucky) to 8 months. Send them the expedite NOW so they know they have to look at it soon. If you hold off on it, it won't seem as urgent to them.

Thank you - I've read that they won't even entertain your request if it's been fewer than 75 days, but at this point, I've read so many conflicting theories that I'm not sure if there's rhyme or reason to anything.

 

I see that you submitted two SRs for the EAD and went through the senator.  Do you have any suggestions for the package that I should put together for my request?

 

1. Letter from employer that I can't continue to work without valid work authorization

2. Medical and dental insurance payments through my employer for me, my husband, and our daughter - indicate in the cover letter that this is our only source of healthcare insurance

3. Copies of bills - car payment, auto insurance, internet, cell phone - do these even matter?  Or is it just electricity, water, etc. types of bills?

4. Is it worthwhile to bring attention to the fact that my USC husband started a business late last year and therefore currently operating at a loss?  This is on our joint tax return for last year, but I don't know if this would help or potentially just bring extra questions for the application overall (not that we lied on the other forms).

 

And is it worthwhile to just submit my documentation to USCIS, or go through our congressperson right away?

I never did an expedite request so my knowledge is a little limited. I did two SR's and contacted my senator simply because my EAD was taking so long. As for contacting congressperson, I would wait a bit after submitting the expedite to see if USCIS does approve it in a timely manner. They do approve expedited EAD's way faster than regular ones.

 

I don't think your bills are necessary to include. You can include info about your husband's new business in a brief cover letter explaining why you need the EAD expedited and listing included documents.
