Hello,

Our casse was sent back to USCIS from Cairo Egypt Embassy after 7 months in AP after the interview ( 7-31-2017 Interview). It was loged back in on 5-15-18 at USCIS - Texas.  How long does it take USCIS to send a REF or NOIR or NOID? I was told 180 days when I called USCIS but the Senitors office said 1 year.  Whats the processing times after something like this?  What can we exspect to happen? When should I hire an Attorney?

Thank you for your email.  We regret any confusion regarding Mr. XXXX immigrant visa application (CROxxxxxxxxxx).  Our records indicate that Mr. xxxxxx immigrant visa case is being sent to U.S. Citizenship and Immigration Services (USCIS) with the recommendation that the petition should be revoked because Mr. xxxxx was unable to demonstrate that there is a qualifying relationship for this visa category.

 

If you have any questions or would like additional information you may contact USCIS at www.uscis.gov.

I would wait for the letter in the mail with a written explanation and go from there.

 

You can either file I-129F again or get married and file I-130.

I'm sorry to hear that! 

It happend to me, but K-1 visa.. my interview was in June 2017 in Cairo, I was on AP for 2 months then they sent my case back to the USCIS , they told us 180 days too but after 4 months my fiance "husband now" got a letter that our petition was expired and we can either refile for the I-129 or get married and file the I-130.

But I had red flags in my interview. They never told us the reason of the denial but we thought about the red flags in my interview..

Did he have any red flags in his interview ?

Hope to hear from the USCIS soon inshAllah..

They're married not engaged and their CR1 visa was denied at the consulate stage!

The Part I highlighted in RED is the issue. They found that he did not prove to have a bonafide marriage with you for the CR1/IR1. What proof did you guys provide of your marriage and how he answered the questions at the interview are key for this. This is a high fraud embassy you are going through so you have to be extra diligent with all your documentation and proof.

My husband had a hard time at the Interview. He was sleepless and the officer kept bringing up age and children and my husband just said "so" and didnt go into any detail with the officer. Total epic fail! Officer told him to send in his passport and family registraition..which he did. We were in AP for about 7 month before the Senitors office told me we had been denied. I was in Egypt with my husband when we found out. I've been to Egypt now 4 times, lived with my husband for 6 months and normal stay was a little over a month each time. Had a nice wedding and party, meet family, lived in the family home with his family, went on vacations together....on and on and on. Supplied all that documentation. Filed taxs together, put him on my credit cards...all the things one can do.

My husbands interview was not good, he was sleepless and stressed and honestly just wanted to be with me during my health issues! I could not attend because I had breast cancer surgery 1 week before his interview with complications. We had also been approved for exspidite at NVC becaiuse of my breast cancer issue.
----->> I will be attending his next interview if we get re-affirmed 

Red flags:
I've been through immigration before, was denied with that Pakistani husband - He ended the marriage after 2 denials. Fraud Officer contacted me and wanted a withdrawl letter. So I gave them one. Was totally transparent about that when I front loaded our I-130 application. Was total upfront with everything. The officer had already known about my current husband from our facebook accounts which the officer said if I went through another immigration process it would not hinder it.....
I am 21 years older than my current husband - he dosent want children and we are both Muslims
My husband applied for a student visa and was denied while we were seperated for a short period.  (we were not married at that time) .....Was transpaent about that too
