Hello,

I'm a USC petitioning my 7yo biological son. During his interview at Manila US Embassy, will that be okay to have my sister-in-law accompany him? Does she need to bring any IDs or documents also?

🌷Came to US in the Spring of 2013 thru K-1 Visa🌷

once you turned USC your minor son becomes automatically citizens of the US....why would you petition him

10/3/2018                  We are still reviewing your case and there are no updates at this time (this is insanity, 4th time while some got GC)

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

That only happens if the child is lawfully present in the USA at the time the parent naturalizes. If the child is overseas, he/she needs an IR-2 visa but will become a USC immediately upon arrival, once admitted into the USA. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

From USEM:

 

**Guardian Accompanying Minor to Interview:  You will need an affidavit of guardianship in the guardian's name stating what capacity they have.  Signed and notarized.

I was not able to locate this in any website. Would u be able to share the link where u get this info from?

I grabbed that info some time back, I keep it on my website ..    I didn't find that statement on the USEM website just now, their new website update moved a lot of things.

 

I did fine notice on the Dept of State website, that pretty much states the same thing:  

 

" If the child is an orphan, or both parents are outside the Philippines, a legal guardian must accompany the child."

Will that be okay to just also have his grandmother accompany him to the interview? So basically, it's him, my sis-in-law/his aunt and his grandmother?

No matter who accompanies him, they will need an affidavit granting legal guardianship.
