We have just received confirmation that the NVC as reviewed our docs and will schedule the interview. However, they are requesting that my wife bring along with her to the consulate a copy of my w2 associated with my 2017 tax return.  As I am employed abroad, I do not receive a w2.  

 

"Regarding evidence of Income for Financial Sponsor or Household Member:

 

My Name

 

[x] A copy of every W-2 form that relates to you 2017 tax returns."

 

Has anyone else dealt with this?  Any document that I can provide in place of the requested w2?  TIA

I hope you are filing a U.S. tax return. Are you? That's your proof. Get a copy of your tax transcripts from the IRS. That's what they want. Proof of income. And if you are being paid by check, copies of checks, etc. Anything that shows your income.

Unless the income will continue from the same source once in the USA, it is irrelevant.  I hope the OP understands that and did not state a "current income" that will not continue from the same source.  

 

The only income one needs to provide evidence of is current income.  Employed people cannot use a tax return as evidence of current income.  Only the self employed do that.

 

At least one complete tax return or tax return transcript is required but the purpose is not "evidence of income" (Self Employed people use a tax return for two purposes while the employed only one.)  Employed people use a "pay stub" and/or "employer letter" as evidence of income.

I have submitted enough documents that they are going to schedule the interview.  Tax returns/transcripts for 2015-2017 were submitted along with a statement from my employer showing my income from 2015-present.  

 

As i filed my taxes under the Foreign Income Tax Exemption, I claimed my current income was $0.00 and submitted a joint affidavit of support with my mom.  This is why being asked to submit a w2 is strange to me, as the documents I submitted show clearly that I was not employed by a US company and I had already claimed that my current income is 0.00.

I was worried about this as my spouse had never worked in the US until the year he moved. He did not have a W2 for the prior year as he was working in Canada. I got his employer to print off a letter on their letterhead explaining he had a full time job, when he started and wages. The Consulate was satisfied and I also included his most recent pay stubs.

 

They are looking for evidence your income will continue from the same source and that it is real.

 

I'll admit I was a bit nervous so I brought copies of all our assets in case this was an issue. It wound up being completely unnecessary but felt we had a back up in case they were not satisfied.
