Evidence for I-751

Alright, I still have about a month left before I can file, but I am getting things ready. Tell me if you think my evidence is sufficient or if I am lacking in certain areas:

- Copy of our son's birth certificate

- Last 3 years tax return (married filling jointly)

- Copies of last 2 leases in both our names

- Copy of joint car insurance

- Copy of DH's life insurance policy showing me as the beneficiary

- Copy of my life insurance policy showing DH as beneficiary

- Copy of my military dependant ID

- Copy of Power of Attorney I have over DH's affairs

- Copy of cable bill in my name, copy of power bill in DH's name, both showing same address.

We don't have a joint account because when DH moved back to OK from NC, he close his account with Bank of America, but they still let charges go through from AOL(which had also been cancelled) for 2 months, as a result, he owes the bank money and they refuse to admit it was their mistake. So anyways until that is cleared up, he can't have his name on another bank account. Do you think everything else is sufficient even without bank statements?

Thanks for your help.

Melissa

I personally would add some pictures together, just to add the "human touch".

Then again, I am pretty positive that I overdid it with the evidence in my packet, so perhaps someone else had better comment :P

We rarely see unsuccesful submissions, so it's hard to say just what the minimum amount of evidence is, but I suspect you've easily exceeded it. A child's birth certificate is pretty strong evidence that your marriage wasn't a sham for the purpose of evading immigration laws. You've combined that with a bit of evidence that you've been living together and sharing finances, so I suspect you're fine.

If you can supplement your package with evidence that indicates you're sharing responsibility for raising your child, that might strengthen it still further (not that I think it needs strengthening). If you have a photo of the three of you together in the hospital shortly after the birth, that might be worth sticking in the envelope. Or you might choose to save a few things "in reserve" for use in the unlikely event they call you for an interview.

Relax, and congrats on the little one.

Hi!

I mailed almost the same things as you including our join checking accounts and paystub showing direct deposit info, but didn't sent pictures. If they need more evidence I will be williing to send it. Didn't want to send pictures cause they are part of me and dont' want to loose them. Especialy the ones where my little one was born.

Good luck you will be fine

I'm of the opinion that if you have a child, anything more than the birth certificate, tax returns, and the deed to the house (or the lease to the apartment) is superfluous. No one I know has tested that theory, however. I sent in more, but not that much more. As you suggest, when a child results from a marriage, it would seem hard to make the case that the marriage was entered into to evade immigration laws.

Meh

We sent colour copies of photos, and printed off some that we had downloaded on our computer, so no originals were sent to them.

Well, we submitted as much evidence as we could think of, all the joint accounts, bills, etc. AND affidavits from a neighbor and a friend and after waiting one year and 3 months, we got called to an interview. I have no idea why but am just tired of proving something that is so obvious in our lives. So interviews do happen. I don't know if it's random or what but I'm hoping this is the last time I have to copy all that information. A lot of people haven't heard back on the I-751 so I consider that we are lucky to even be looked at right now.
