If you have proof of delivery, and if the denial was solely based on USCIS saying they didn't receive your response, you can file an appeal.

If the denial was based on your response to the N14 not being sufficient enough, then an appeal won't work in this case.

Would all depend on what it specifically says in the denial letter.

Yes, in my denial letter, it says" During the interview and review of your application, the Immigration Services officer determined that your application was incomplete because it lacked supporting evidence to establish your eligibility.  On May 15, 2018, USCIS issued a Form N-14, Request for Evidence, asking you to submit proof of XXXXXXX.  This information was due to USCIS  no later than June 15, 2018.  To date, you have neither responded to Form N-14 nor requested additional time to do so.  Since you have not responded with the requested information, USCIS considers your application abandoned. If you believe you can overcome the grounds for this denial, you may submit a request for a hearing on Form N-336.

The thing that I don't understand is even for the documents I submitted in person to the field office, they said they didn't received, is it because I submitted on the last day?  The lady at the front check-in desk told me "don't worry, for sure I will pass your documents to the officer".

I mean, you could TRY to win an appeal if you have proof of attending the infopass appointment...

Without being able to prove you actually submitted the evidence at your evidence though, and without proof that the officer handling your case received the evidence before the deadline...much easier to just submit a new N400 application.  Cost is pretty much the same.

 

Submitting it on the last day was seriously pushing the deadline, yes.

Thank you so much for the suggestions, I don't have the approve for the documents submitted on the last day because I didn't get an infopass number, but I did have the proof that I mail the request for extension the deadline and the mail was delivered before the due date. is this sufficient?

I meant I just gave the documents to the front desk lady, and she said that she will pass the documents to the officer, I think she must messed up.  But their video camera should capture our appearance during that time, right?  how to obtain this proof?

No government agency is going to hand over a copy of their security video tapes to a civilian without a court order.  You're grasping at straws there.

 

At this point, without any proof of submitting the documents requested, your option is to re-file the N400.

The issue is that the front desk lady may have passed your documents to the officer, but the officer may not have stamped them before the due date.  You should not submit paperwork on the last day due to this reason.  The front desk lady does not know that it is the last day that they are due, she only provides the officer the paperwork.

I saw the front desk lady stamp the first page of the document with the due date, and she understood it was the last day, so this is why she told me "don't worry, I will make sure to hand over to the officer"
