Hello all,

 

I'm at the stage where I am applying for AOS and I had a question regarding travel:

If I do not complete the Application for Travel Document (I-131), would I be able to travel home in the event that a parent passes away? 

 

My father is 70 and lives alone after my mother left him last year. Last year he was hospitalized and I'm dreading that something happens and I cannot return home for a funeral. However, the $660 filing fee isn't small so I thought I'd read between the lines first.

...all these file names are going to my head. I just read that you need not pay the fee if you apply for AOS after july 2007. please ignore this thread...

  1. As discovered, there is no fee for the I-131 when filed due to, or concurrently with, a pending AOS application.
  2. If you leave the US after entering on the K-1 visa and without advance parole (via the I-131) or the green card approved, you will need a new visa to enter the US. If you filed for AOS and leave without AP or a green card, then the AOS application is automatically deemed abandoned.
    1. ETA: ~3-6 months from from AOS + I-131 filing.
  3. In the event of an emergency, you can request emergency AP at that time.

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
