K1 is a FIANCE visa (ie NOT married). By entering on a K1 already being married, they violate the terms of the visa which regardless of WHAT they did or did not say at the interview is STILL VISA FRAUD!!! So they may not be lieing, but they are still committing fraud that way.

Not only do you post very bad advice and breach the TOS for VJ but you also think it is ok to insult anyone who calls you out on your bad advice....

I still want to know what this guy was thinking. :blink: Why would you go through all the trouble of the K-1 process, be granted an interview and then waste all that time and money by marrying early??

I applied for a visa for my fiancee in December 2006 with I29F. We have received an interview date for June 18 at the the U.S. embassy in Manila.

I have some good news and bad news, good news is congrats on getting married, bad news is "What were you thinking, its at the best interest of your wife and yourself not to reveal anything to the consulate because if you do your entire process will be denied and you would be placed on administrative review, which can take a while to fix, they are going to look at you as if you were trying to cheat the system. My father did the same thing back in 1997 and he had to wait almost three years to fix up his mess with the act of congress on his side, and I don't think you want to endure that horrible process, its probably a little faster now but not by much. Like the military says, don't ask, don't tell, keep it your little secret! Best advice!

First off, if you read my message carefully, I didn't tell him to lie, it simply tells him if they don't ask about it don't mention it, my ex military buddy is a adjudicator at CSC, plus that same scenerio happen to my family member, I would never misdirect anyone, if they ask then you tell them, please consult your brain before you open your illiterate mouth!

TRUST ME, I read it carefully. Lies of omission are still lies. Some of the best advice I received during this process was from someone whose job directly dealt with matters of national and international security, who told me to be honest and upfront about everything -- if they find out you are lying or covering something up or being deliberately misleading, you will be in serious, serious doodoo.

I will reiterate with my "illiterate mouth" what I said before: worst. advice. ever.

Really sh!tty advice. Even aside leaving this misrepresentation and the fact that as a married woman, she is not eligible for a K-1 visa: how are they going to adjust status from a K-1 with a marriage certificate dated before the interview?

To the OP: you can't switch from a K-1 to a K-3, unfortunately. You'll have to cancel the petition and start over, but, you know, congrats on being married!

If I were you... I would go to the interview, explain whatever reason you had to marry before the approval... and who knows... that might let your fiancé come to the US and have you do the AOS (adjustment Of Stattus) right away.

But NEVER lie!

She's no longer a fiancée....she's his wife. It ain't gonna happen no matter how many scenarios ppl on here come up with.

OMISSION is the same as LYING. The "don't tell" policy doesn't work here. I hope Captain does something about your obvious cruddy advice.

I just read yesterday this report in the NEWS tab.(Husband Seperated from Wife and Children Due to Marriage Before Entering on K-1 Visa - 10 Year Ban) http://www.visajourney.com/news/2007/04/07/17/

Go there and check out a similar case that they got married in between the process and now they are having a legal and worst problem for going on a K1 visa instead of changing to a K3.

Do not lie, the truth will help you more than anything.

Wow, what a thread. A lot of emotion here. The only thing that really sticks in my head is: Why did you marry with an iterview only two months away? What were you thinking? If you only waited to bring your fiancee to the U.S. in June, then you would not have to start all over and wait another 6 to 8 months. Jeeeez!!
