USCIS guidelines state that the beneficiary and petitioner must meet in the two years prior to submission of the application. How is that two year time frame determined? Is it from the date of the NOA1, the postmark date, or some other date altogether?

So it would be February 1? We have a RFE and are down to a matter of days with the two-year requirement. I am trying to ascertain which date USCIS used.

is your meeting within 2 years that close to your filing date??? (As in, you met 1/31/05)?

Yes. I visited him from December o4- February 1 05.

He's actually here in the states now and I am trying to figure out if we will end up needing to reapply using this trip as primary evidence of meeting.

What's your RFE for?

Evidence of meeting in the last two years. We ahve a meeting with an immigration officer on Thursday so hopefully that will help.

hmm, I wonder if USCIS used the NOA1 date?

I think they might. We had anticipated that this might happen, but it is still disappointing.

just to clear up a slight logical ambiguity... if someone would be so kind as to confirm or deny this...

when it says you must have met in the last two years, it means that you have had face-to-face contact in the last two years, not that you first met each other within two years.

you could have intially met and fallen in love 10 years ago, but as long as you've been together in the same place, within the last 2 years, you've satisfied the condition.

I sent boarding passes, itineraries, photos, and receipts from our last meeting, so I'm not sure what else they would want. I think the date might be the issue here...

That is how I understand it. Meowboy and I began our relationship in 1999, but our last meeting (prior to the current one since he is here now) was from mid-December-February 1 2005.

Exactly. If you met in 2000 at a party but did not become a couple until you ran into each other again in 2005, your first meeting was in 2000. But you would still need to show proof that you had physcially seen each other in the two years prior to filing.

Hard to understand why there would be an RFE to prove that you had met in the previous two years - sounds like you sent plenty of evidence. Then again, WHEN was the evidence from - when did you last meet in person?

I'd be surprised if you had to start all over. When submitting proof for the RFE it would probably help to show that he's here now as proof of meeting also. But, of course, whatever the immigration officer tells you is what you should do! I'm just surmising. I've never see this situation before.
