Today she goes to INFOPASS, why don't we wait & see what's said....instead of beating a dead horse?

They'll probably tell her to get married. That's what happened in the other case I'm familiar with.

A UK immigration lawyer I saw in London told me to get married so I could stay but I didn't!

IF you could assure yourself through research that you would face no ban or greater legal hurdle later on................

Why do you think there would be a ban?

I don't. I just don't know - so I want to impress upon the OP that further research is never a bad idea!

So we went to the Infopass appointment this morning.

I asked the officer about the RFE and the two-year time frame.

-The officer said that we just need to resend the information we sent originally, but organize it with a cover sheet, colored tabs and the like. This was totally not what I expected to hear, since I did complete a cover sheet with bullet points in my original submission. Apparently we need to keep the interest of the officer reading the application - at least that was my impression based on the officer's comments.

-The officer also said that we should include evidence of Meowboy's current visit in the packet. I asked if it would make any difference due to the fact that the visit is post-application. He said "send it along, why would they make you reapply?" or something along those lines. Also unexpected.

-He never gave me a firm answer about the date used for the two years, even though I asked him the same question three different ways. From what I heard, the actual date seemed less important than the quality and organization of other evidence.

The officer seemd fairly confident that we wouldn't receive a denial if we make those changes. Our plan at this point (even though we are uncertain and more than slightly confused) is to answer the RFE, pointing out that we mailed the information within the two-year deadline (I have proof of mailing exactly two years to the day). We will include past evidence (organized nicely with colored tabs and divider pages and whatever else we can come up with) as well as current evidence (boarding pass, itinerary, short-term lease and letter from landlord with both of our names on it, photos together and with family, etc).

If that doesn't work, we have some other things to consider...

I'm shocked at that. Also, as someone here said, the two offices DO NOT 'talk' to each other so he could be wrong. PLus he seems misinformed as this is about an ALREADY FILED petition, current info should not be applicable.

Good luck. Please keep us posted.

Thanks for the update! I've been keeping an eye out for this! Pretty crazy stuff at Infopass! Who knows, though?? He might just be right! Since you don't really have any other options, you may as well give it a shot! Good luck!!

  • 2 weeks later...

Although the case website hasn't been updated, my USPS delivery confirmation shows that our package was received yesterday.

Our response to the RFE is highly organized, while using a simple and concise style for increased accessibility by the readers. Lots of bullet points and bolded phrases to call things to their attention, and minimal use of text.

We included information from the trip in 05, proof of delivery of the previous application on Feb 1, 2007, and details from his current visit.

If nothing else, we have gotten ourselves organized for our appeal/reapplication...

Prayers and positive energy would be appreciated!!!

What is the average amount of time to hear back from CSC? Is it a few weeks? My situation is a bit strange, I understand, so the average may not apply here...

Lots of touches in the past few days! Fingers crossed for good news, but I'm going to start organizing details for reapplication or contact with congressperson, just in case.
