Filing before/after Fiance arrives for visit

I am currently preparing form i-129f. My fiance will be visiting me in the US for about 2 months, arriving May 14th.

 

Does it lower my chances of approval if I wait until he arrives to send the form? I would have to say that he is currently in the country. I have a feeling that doesn't look very good.

 

Also, if I manage to complete it before he arrives, I would have to say that he is not currently in the country. But if USCIS doesn't receive the form until after he arrives (due to the time it takes to be sent through the mail and processed), would that be considered false information, even if it was accurate at the time that I wrote it? Even if they don't open the envelope for another 6 months (the current processing time), do they count the form information as being accurate on the day it was postmarked, or on the day that it was received at the filing center?

Whether you file while his is in the US or not will not affect the result of the petition or obtaining the visa.

There is a small section to complete on the I-129F if they are in the US when you file. The information needs to be accurate as of the time you file it. I wouldn't worry about when exactly they open it. Just fill it out honestly as of the time you send the paperwork and you'll be fine.

i think what you mean in that section mainly is to see if they are here living in the US, not if they are just visiting for few months and leaving
