We went to Ciudad Juarez last month , husband had his interview on the 30th , they gave him 221g form , official told him it was about a police encounter he had in 2010 that he doesn’t recall & that is the only thing holding him back since he has his Pardon and all (he also has DACA) , I had to come back to US with our 4 kids . Even though it’s barely going to be a month it’s been the longest month ever !!!! My kids miss their father , he has no arrests , no felonies or anything like that , our lawyer was even puzzled about them giving him the 221g form over a police encounter . Has anyone went through something similar ? And how long did it take ? My lawyer says it should all be okay but I’m worried , I’m alone with 4 kids thousands of miles away from my husband /their father . I know every case is different , but I’m pretty desperate to find answers or at least see how long similar cases took .

Would depend on the specifics.

What do you mean by "police encounter?"  Was he detained and questioned for something but never actually charged?  

 

More details on what exactly happened during the encounter would help us be able to give you adequate advice.

they just said a police encounter in 2010 and which city. He has never been detained or anything like that . He asked the official during the interview “what day in 2010?” and stuff like that but she said “all it says is encounter (& what city)” 

my husband and I already had 1 child and I was pregnant with another that year and we also got married that year , and he still can’t remember what they’re talking about (& neither can I) I tried going to the PD & get police report or whatever and they said they can’t give me any info 😏

My brother in law says it might b the time he, his wife & my husband got pulled over and they got their names down and that’s it . (They got pulled over cuz they were driving my father in laws truck and my father in law was in some trouble) . 

My husband says he doesn’t fully remember that , but apparently my mother in law does and says it’s more then likely that . Asked my lawyer if it could be something as simple as that and she said yes . But either way , I just wanna see how long it took other cases to get through something kind of similar to this . From what I’ve looked into I think they’ll be running extra background checks ? I don’t know . I know my lawyer says not to compare but I wanna have an estimated time on how long It’ll take to get a response . Having 4 kids ask repeatedly when their dad is coming home is getting hard to answer . The official had told my husband he’ll receive something in 2-3 weeks , but obviously doing my research I’ve seen that it’s more then likely always longer (Which it has been since we’re going into the 4th week, which I know isn’t a lot but for my kids it is 😢) 

 

Oh & consulate kept his passport if that makes a difference ?

Police departments normally do not disclose information about someone else, unless you have written authorization from them in some cases---your husband is the one who would have to request it from them personally.  Perhaps he can find out if any arrest report still exists, should he want more info on it.

 

Any arrest/charge is going to hold you back a bit in processing while things get checked out...if what you mentioned before is the only less-than-stellar moment in his background, then all may work out for you in the end.

He has no arrests or felonies or anything like that , thankfully , which even official told my husband during interview , I think it’s more because he couldn’t recall what they were talking about ? I mean something that happened 8years ago , especially something so small as that is pretty easy to forget . & thank you, I really hope it does , since like I said , our 4 kids miss him so much , as do I of course

I wouldn't say easy to forget, especially if he hasn't had many interactions with the police.  Perhaps it could be some nerves getting in the way of his memory during the interview?  Or he is embarrassed and doesn't want to tell you what happened.   Unfortunately the only thing you can do at this point is wait to see how it pans out.  Good luck!

I think it was the nerves of the whole interview . I mean most people are usually nervous about it, and then everyone at the hotel kept saying all these “horror stories “ about the interview so that didn’t help 🤦🏻‍♀️ He claims that he can’t think of anything else, that it has to be that , wish he would have remembered during the interview though 😐 maybe we wouldn’t be stuck in admin. processing , if he could have explained it . Either way what’s done is done so I’m just hoping all goes well . .& Thank you .

Probably nerves, but the fact that he questioned the CO about it for clarification shows he was willing to at least talk about it----if he knew what the CO was talking about---instead of just trying to evade/hide the topic altogether, I suppose, so that's a good thing in his favor hopefully.
