Hello everyone,

 

My Filipina fiance and I plan on submitting the petition for the K1 Visa, but we have a question in regards to our situation. 

 

She has been previously married, however, her previous marriage was annulled, and all of the documents were submitted to PSA. Here is our issue, she currently does not have the original copies from the annulment, and we are both very frustrated and confused about what documents we are going to need for the visa process concerning the evidence and annulment of marriage.

 

If someone could please clearly list the documents we are going to need for this process, and how we are able to obtain certified copies, please advise us if you can.

Diclaimer here, I'm not pinoy. I'm just somebody who used to work in an employment agency so I may be wrong.

 

You have to be quite precise here, did she divorce or was her marriage annulled? If it was truly an annullment, she should be able to apply for a CENOMAR with PSA.

If she was divorced, she should look up the family lawyer she undertook at that time. She should be able to get a certified copy. She should make at least 3.

 

Otherwise, has your fiancé tried to contact PSA and ask if they could redeliver her documents?

Thank you. Her marriage was annulled for certain. I read it said she would need proof of annulment, and I was curious if the marriage certificate with the annotated annulment would satisfy this requirement, along with the CENOMAR.

FYI

 

If it was done inside the Philippines then divorce does not exist in Philippines, unless you are muslim and then that is a whole different ball game.

Just when you think you have TDS eradicate,  a new case shows up.

Also to piggy back off of what you said is the USEM WILL NOT accept a divorce decree from a Sharia court UNLESS you and your X were married by the Sharia court. They started enforcing this rule about 1 1/2 years ago na because the Philippines asked them to start enforcing it.

That should suffice and MAKE SURE SHE IS ABLE TO GET A CENOMAR not a CEMAR.

If that lawyer is credible which half of them in the Philippines aren't and just want to take your money for simple stuff. I expect that the lawyer will give them the paperwork for maybe 5000 peso.
