HELP with F1 status

Timeline

Thread is moved from General Immigration Discussion to the Student & Exchange Visitor Visas forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Well, did you stay in the US after dropping out of school? You just say,

The question about,

is for you school. Whether you can continue with your studies and finish whatever you were doing is not a visa issue, is a school issue.

Of course I stayed in the US. If I got out of the Us is a different issue. It’s not about me but asking about some friend of mine. They came went to school for 2 semesters then didn’t go to school anymore till now it’s been 2 years. Just staying in the US with a violated F1. Now they want to go

back to school my question is: is there any way to get back in f1 status ? Doesn’t have anything to do with visa cuz they are already in the us.

It would be better if they contacted the university they attended and ask the international advisors. 

 

I would say that it is not possible. 2 years is too much and not being able to pay was not "beyond your friend's control". Usually, they allow to regain F-1 status if you had a medical injury that did not allow you to be a full-time student and, at the same time, you were not able to leave the country. Moreover, reinstatement might only be available if your friend had stayed only 5 months after loosing status for some extraordinary circumstance. 

 

Also, if your friend was not able to pay tuition, how he or she was able to afford living without working raises another issue. If your friend was working illegally, that is another can of worms.

What is that does not make any sense to you????

I didn't post this to raise criticism, but rather to get information from people that have gone the same route!!!!!!!!!!!

 

I was asking for advice not to answer my questions with another question.

We often find with third parties asking questions that important details are not known or mentioned so when such stories are recounted and there are obvious illogicalities they need to be mentioned.

If you're asking for a 'friend', clearly state so in the initial post. Gets confusing otherwise, as some members often look at past posts to offer advise. 

Or better yet, have the friend create an account and seek answers. Everything is clear that way..

Thanks for your advice. As i am typing the friend is next to me. If you have any feedback/questions about the situation let me know i can elaborate you more on that.

99% i know theres no way to get back in status unless if you leave the country and come back.. but we thought of putting the question here just to see if somebody had feedback for that 1 remaining %

I doubt your friend will be able to come back by leaving the country and applying for a new F1. Your friend has already violated the rules of the F1 visa so the chances of getting a new one are slim.
