Dear Vj memebers,

 

Kindly help me in filling form I-864w. 

I am widow of a US citizen and residing Abroad. I am requesting you guys please help in filling tips, documents need to be attached , when filing abroad.

The I-864W comes later in the process, and would be submitted to the embassy. It's a simple one-page form that takes only a few minutes to complete.

 

But filing an I-360 within two years of your spouse's death would be the first step you would take. The I-360 should be filed directly with the US embassy having jurisdiction over your place of residence.

OP said the husband filed an I-130 for her in 2014, but died six months later.

 

Under 8 CFR 204.2(i)(1)(iv), the pending I-130 should have been automatically converted to a pending I-360 by USCIS once they were notified of his death (usually by providing them with a certified copy of the death certificate issued by a competent civil authority).

 

If the I-130 had already been approved, then it's converted into an approved I-360 under the same process. OP would need to provide more information.
