Hey guys,

 

I'm filling in my portion of the I29f (I am the foreign fiancé) and under question 38a it's asking about previous visits to the United States.

 

I am from Australia and hold a B1/B2 visa and enter on this visa. The visa is in my old expired passport but as the visa is still valid I just take both passports with me to the point of entry (my current passport and my expired passport with my printed visa inside)

 

When I searched online by my current passport number to find my I-94 arrival - departure record number it states the last time I entered the USA was July 2017 (it was actually October 2017)

However when I search with my old expired passport number (the one with my visa inside) it shows my most recent visit in October.

 

SO my question is lol.

 

For question 38e when it asks for passport number which number am I putting in?

my actual passport that I travel on? Or the expired one that for whatever reason they linked my last entry too..

which I feel is a mistake because that passport is OLD and the new passport has all of my previous I-94s linked to it..

 

Please help! I'm just worried one stuff up on my application will delay my entire thing but I don't know which is the right thing to do?

/ can I call immigration and ask?

I also had a problem with my fiance's I-94 because, long story short, it showed that he entered (May 22, 2017) and never left. So I just included a letter addressed to the CO as a supplement to his I-94 that explained the mishap, I attached a copy of his passport, his original flight itinerary, a headed letter from the airline stating the mix-up, and the luggage tag from his flight back to London. 

 

Personally, for your situation I would type the I-94 on the page how it shows up online. I would also include a letter addressed to the C.O. as a supplement for the question that includes an explanation, as well as a copy of the bio page and visa in your old passport and the BIO page of your new passport to show that you  have one that's not currently expired.

 

Overall, I wouldn't stress about it too much! Info for the I-94 comes from many different sources and is often incomplete. :)

Thank you so much! After I posted this I actually went back and looked over the question again and it's not very clear.

The question actually asks has your beneficiary ever been to the United States?

then after says

If your beneficiary is still in the United States complete item numbers 38a - 38h

 

...

 

so to me I understand that as technically because I'm not still in the United States I don't need to fill in any of those questions about my arrival record?

 

please help this form is so confusing !!

37. Yes if you have been

38- no you don't have to fill unless you are in the states

I feel like I should but my fiancé thinks I'm overthinking it and to leave it blank lol especially because my last entry was linked to an expired passport (clearly an error on the poe)

 

how long ago did you submit?

and what stage is your application at now?

I did too. But it is actually not tricky if you read the instructions reeeaaaally carefully. 

 

So so I was actually worried about filling it up for a while and still hope they won't ask me why my I-94 says I left by then but I said I was in US.

 

37 and 38 are different and separate questions , that seems like the important part here (I didn't think about it when I was doing)

We are both still waiting for noa2. But I literally gave you the answer that you'll find all over this website because it is not a rare question.

We are both still waiting for noa2. But I literally gave you the answer that you'll find all over this website because it is not a rare question.

I put it wrong. And hoping it won't affect much as they can reach my i-94 with the information themselves.

 

I didn't know this forum beforehand.

 

what I'm telling you is the right answer. This question has been asked 100s times.

 

if you want to check, google "visa journey k1 I-94" you'll see all of the other topics. But do at your preference.
