My wife had the CR1 interview yesterday at the end of which she was given 221-g stating that they need a Joint sponsor also. Telling her to submit I864 & I864A( If the joint sponsor income doesn't meet the poverty guideline criteria) along with IT Return and W2.

The joint sponsor has to be a family relative or it can by a friend also? coz i don't have any family here.

When i filed the affidavit of support as the petitioner, I made sure to check the poverty guidelines and had the numbers more than that. For household size 2 the guideline says $20300. And I showed 24000 for this year and 23000 for last year. Still they've asked her to send a joint sponsor now. SMH

Also if anyone can hint how long it might take after we send vfc the documents

Thanks

A Joint Sponsor, can also be a lawful permanent resident (LPR) and be at least 18 years old that meets the income requirements and must also have a domicile (residence) in the United States. He/She can be a family member of friends etc.

The Joint Sponsor also have to submit an Affidavit of Support, proof of their income, and proof of their legal status in the United States.

Remember:  Even if a petitioner finds a joint sponsor to financially sponsor a visa applicant, that petitioner must still submit an Affidavit of Support. Do you know how long it would take after we turn in the required documents? I know no one could be accurate in days being taken.

So I'll be sending my friend's AOS, his Income tax return for 2016 and W2. I'm also attaching copy of  his green card just in case.

Anything else I should send to my wife?

Thanks a lot

You are good with the documents you are will be sending, in fact more than good :)

For the duration, it usually depends on the consular office's work load, I am afraid no one can tell you the exact number of days, but the good thing is that you got the documents just try and send them as soon as possible.

Another question for you Binna,

I just noticed his return had his wife's name also. but he's the proprietor. It shouldn't mess up would it? Meant to ask I wouldn't need I-864A from his wife right?

Thanks

If he filed his return as Married filing jointly, then his wife needs to fill I-864A.

The only conditions that won't require his wife's I-864A are if he filed his return as: Single, Married filing separately or Head of household.

But Binna, she doesn't work. The W2 corresponding to the return are my friend's. Still we'd need I 864 A?

It doesn't matter if she works or not, should could be receiving some sort of income somehow, thats why I said you should check what his filing status is in his most recent Tax return or Tax transcript. If the status says any of Single, Married filing separately or Head of household, then his wife doesn't need I-184A

I have a business where I draw salary every month & at the end of year add my business income to it, but seems that wasn't enough

On his Return it does say that he filed jointly.

So i guess I need to get that I-864A filled too. Better wait n get everything right rather than getting notified by consulate again

Thanks Binna
