Hi everyone,

 

Just a (relatively) quick question! I am a UK citizen applying for a CR1 visa in the UK and will have to use my mother in law as a joint sponsor with my wife.

 

Currently my wife lives with my father in law and his wife, my mother in law lives with her husband and daughter. My question is, do my wife and mother have to account for my father in law and step mother in law when it comes to household size? It doesn't matter as she earns enough, just want to know what to put on the I-864 when it gets to it.

 

EDIT: I will also be living with my father in law when I move until my wife and I get off our feet

Are you asking that her ex-husband (father of your wife) and his wife will be part of your mother-in-law's household size? Unless they still filling tax return together or they are shown as her dependent on her tax return. Then No.

Sorry for the all the questions, so would my wife and I become dependents of my mother in law as my wife is currently unemployed (she just spent 6 months in the UK with me), and my wife would list her householdsize as 2 for her and I?

Mom's household size for this form is Mom, her husband, her daughter that lives in the house PLUS the immigrant.

 

Your wife's household size is wife PLUS Immigrant.

 

The only variation would be if Mom lists your wife on her tax return to claim her as a dependent. Then she is part of her "financial" household.

 

Or if the girl who lives with Mom and step-dad is an adult with a job who files her own tax return and is not claimed as a dependent on Mom's. That girl (if a self-supporting adult child) is not part of household size for this form if she's not claimed on Mom's tax return.

Anybody claimed (listed) on the most recent tax return as a dependent is on the household count of the person filing the tax return. By listing somebody as a dependent, it means they claimed to provide more than 50% of that dependent's support during that particular tax year. 

 

Ask who Mom lists as dependents on her tax return or who she plans to claim when she files her 2017 tax return because that may be the most recent by the time you need the I-864.  There are  IRS rules for claiming somebody as a dependent.  Here's a brief summary to see if your wife will qualify to be on  her mother's tax return as a dependent https://www.1040.com/assets/PDF/Dependents-TY16.pdf
