Citizenship eligibility, Help needed please!

Hi guys

I immigrated to US in 2015 April and its with F2A. My husband was green card holder at that. Then in 2016, He became US Citizen. So I can file my citizenship after 3 years from husband’s citizenship date. Is that right? Because Married to US citizen requirements are, Has been married to US citizen for 3 years, Spouse is US citizen for 3 years and residing in US for 3 years. I will meet all these requirements soon and wanted to know If I can apply before 90 days of eligible date. Appreciate your responses. Thank you.

05/24/2013- NOA 1 (PD)

09/09/2013- Transferred to NSC from VSC

09/17/2013- NSC started processing

11/06/2013- Received Approval- NOA 2

tell us the first day of your being permanent resident (on the green card) !

 H1b ---> EB-1A (I-140) ---> I-485 AOS(Green Card) ---> 5 years --->  US Citizenship N400 application

  • Day 011/16/2017, e-filing N400
  • Day 3069/18/2018,  interview day--passed and in line for oath.
  • Day 332: 10/15/2018, Oath Day

you are the LPR since 4/30/2015 . Your husband became US citizen in 2016. 

It’s important to note the condition that you have been both married to and living with the U.S. citizen for the entire three years.

If, for example, you and your U.S. citizen husband have separated, divorced, or merely started living in different cities, then you are no longer eligible to use this exception.

Similarly, if your husband was a LPR at the beginning of those three years and only recently became a U.S. citizen,  you must wait until he has been a citizen for a full three years before making use of this exception.

Yes absolutely I am aware of those things. 

We are married since Feb 2013 and He is in US since Sep 2007. I came to US in April 2015 and he got citizenship in March 2016. So I can cpunt 3 years from March 2016 and we are happily married and living together. Thank you.

then you have nothing to worry about. you are good to file by the end of 2018

This is wrong! You can’t be restricted on the interview for filing 90 days prior when your eligibility window opens up. This can only be an issue if on the day of the interview you haven’t yet fully clocked in on the 3 or 5 year mark which seldom ever happens as it takes more than 3 months from filing to having biometrics and subsequently being scheduled for an interview.

You’re more than welcome to file 90 days prior when your eligibility window opens up; however, to be eligible on the day of your scheduled interview you must’ve been a permanent resident for 3 years, been married for 3 years and your spouse must’ve also been a U.S. citizen for the past 3 years as well to be eligible. With the monstrous backlog facing many USCIS local field offices nationwide, you shouldn’t have any issue with this when you file.
