Good morning,

I have some questions. My sister is Filipino citizen and her husband is American citizen. Their child was born abroad and has American citizenship. The father is back in u.s. And My sister is currently living in the Philippines with her child. She wants to apply for her child dual citizenship in Philippines. But the problem was the father of the child has the child's passport. And the passport and visa are probably expired already. What is the best thing she can do for her child? Pls help?

Has the child ever lived in the US?

The process is not a "dual citizenship" application.   

 

The process for your child is called Report of Birth when a child of a Filipino citizen is born in a foreign country.   You should have reported the birth of your child to the Philippine consulate representing the area/country of birth.  You will still need to do this through the consulate that represents the country/area of birth.      You can request a Philippine passport upon completion.

 

What country was the child born in?

 

I will give you a link for the Philippine embassy in the USA, process is basically the same everywhere.  You will need to go to the correct consulate website and follow their requirements.  This can be done by mail.

The child was born abroad, not Philippines or u.s.

The child never live in u.s. But already been in u.s. Probably couple of times or more.

Without the report of birth complete, your child entered the Philippines using the BB privilege in the U.S. passport?   This is only good for one year.

Why wouldn't she do a CRBA with USEM since she is in the Phil?  It would be much easier.

CRBA was done in the other country (where it had to be completed), the child has a U.S. passport and has been to the USA a few times.  ROB wasn't done.

 

"The birth of a Filipino should be reported to and registered with the Philippine National Statistics Office through the Embassy/Consulate General having jurisdiction over the locality where the event took place."
