Hi,

I need some help, I am just overwhelmed with all the paper work. I am a Canadian female and I am married to an American male. I am in the US (Florida) for the winter. What paper work do I need to file in order to be able to stay in the US while the process is going on?

As long as you entered the US legally, you can file an Adjustment of Status. Once you file that, you will not be able to leave the US until you get either Advance Parole or  your green card. So not only will you be able to stay in the US throughout the process, you will actually have to stay in the US. 

 

If the border officer had thought you were going to try to stay in the US after being admitted as a tourist, you would probably not have been admitted, so you got lucky there. Entering the US on a non-immigrant visa with the intention to adjust status is against the law, so I'm sure you didn't do that...  but you're here now and there's nothing against the law about deciding to file an Adjustment of Status to stay here with your spouse.

We were married 1 year ago. We have been together for 10 years. I have been going back and forth since we met. We didn’t know when we wanted to move in together because there was always a reason why not to move in yet...work is pretty much what stopped us. I came over to spend some time together and we where just talking and out of the blues we decided it was time. So here I am. I don’t think i did anything illegal.

Im in the same situation as your are.  We got married December 2015 and visited each other quite often. our jobs made it harder to decide whose gonna move and we were leaning towards moving to Canada but my job loss turned our plans south overnight. Recession in Alberta hasn't been helpful at all
