N400-What to be prepared for 3 year rule citizenship interview?

Hello everyone,

 

I just got my 10 year green card recently, so I want to apply for N400 citizenship interview? I heard that I will need to prepare a lot of documents to prove my marriage and my husband is required to go with my in the interview too. Is this true? My husband is really busy with his work, so this is hard for him to accompany me to the interview.

Could you please to share me some experiences about preparing documents? Because It have been a while we did not use my joints bank with my spouse. Should I wait for 5 year  and apply for N400? Because someone told me that my green card will be revoked if I don’t support all documents they required. I am so worried about I should apply now or wait 2 more years.

Are you already married and residing in the States for 3 years?

 

I don't know if your husband needs to be there under the 3 year rule but I'm sure that if he shows the invitation letter to the employer he will be able to get time off.

 

Whoever told you your GC will be revoked is wrong. They might reject it or give you an RFE. It is true however that they'll take your GC at the oath ceremony as you're becoming a citizen that day.

Your husband can certainly accompany you to the interview, but he would have to remain in the waiting room while you are interviewed alone.

regardless of whether you go now or in 2 years - they will still question how the GC was obtained - so they will ask questions about your marriage to ensure it was bona fide.

 

and regardless whether you have had the GC for 3 years or 5 years, if they come to the conclusion that the GC was not obtained legally , they can revoke status regardless of how much time has passed.

 

the citizenship interview is the last gate at which they can question the status as a whole.

 

also , if you do intend to file , make sure the proof of joint lives exists and is documented....if you cannot provide the documentation they request via the Request for Evidence document ( if they send you one) , they will send you a Notice of Intent to Deny ( status ) which you can appeal if you have the requested documentation and can show it to them....

Your husband is not needed at the interview. You will be interviewed alone. If you apply for citizenship based on 3 years rule, then you will have to provide evidence of your ongoing marital union. You can do this by providing joint credit card statements, bank account statements, income tax filings (tax transcripts), home, health, auto insurance, rental deeds, utility bills, birth certificates of biological children(if any) and other documents that may apply to your case. The more documentation you take with you, the better it is. Not all of these documents are not needed when you apply but you need to take them when you goto the interview.  Go through the N400 instructions to get more information.

 

There are other conditions as well that you need to satisfy in order to apply based on 3 year rule. Go through the naturalization manual on the uscis website and you will get all the information you need.
