  We had 3rd interview (I 751 )on August 29th . IO said that if he needs something it will send a letter and than he change is mind and said that is going to to take decision. 

  I had infopass today for Stamp in my passport (I 551) and I got it only for six months. 🙁

 Any similar situation?

Congratulations - you have have beaten my record not only for time since originally filing, but also number of interview attempts and generally being messed about. 

 

Firstly, are you still married and living together? If so, file your N-400. This will force adjudication of the 751 while also making you a citizen. 

 

You could also file a request with your senator or congressperson(or both). This gets auctioned very quickly once they contact Uscis, but only if they agree to help.

 

The final option would be file a complaint with the ombudsman, but they can take several months to respond and action anything (they used every available day when I did this).

 

 

Or, you can do nothing and just wait...

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Yes I've seen someone on trackitt i-751 site that reported 2 interviews and total processing time of +1600 days till approval. But what was wrong with your case? Since you say "we" I am assuming you guys are still married, was there any red flags? Do you have a pending N400 also?

  We get married in 2011 and we still married and living toghether . 

  For I️ 751 we file in dec 2014 and last year in October and November we had stoke interview with same IO                          We had some discrepancies 

   name on lease spell wrong 

   We had 3 cars and my wife forgot to mantion one 

    My wife change her driving license after 4 months after we move ( we have like 4 yers in same address now)

    Second interview was about 3 hours and officer was rude and disrespectful. 

   I don’t know if I need to call this red flag but my wife is older than me (8 years) I don’t see something wrong ( president of France is 41 and his wife 60) 

  We filed N 400 in July last year and i just got mail in October that i am in line for interview. 

   infopass? Got stamp for 6 months because my passport is going to expire in 7 months and officer told me that I will have an answer soon.

I think its more than 8 years of age difference. Why they waste time by interviewing an applicant 3 times. You can have lease in both names and live together but they do check if you are really living as a married couple.

I doubt the age difference is a red flag during I-751. That usually causes issues at AOS stage but you guys passes that part long time ago. Could be lack of financial co-mingling but after 3 interviews who knows what they still have in their minds. I've also seen home visits by agents if they are still unsure. It may happen to you too.

 

But meantime you should contact your congresspeople and ask assistance as soon as possible. Contact both Rubio and Nelson's offices; as well as your House Rep. Check their websites for case assistance information.  Whoever responds fastest and sounds more willing to help continue communicating with that office. Also file a case assistance with the ombudsman's office but keep in mind ombudsmans is slow, usually takes 2-3 months to get an answer. Congresspeople are usually the fastest to get an answer.

 

It's good that you have a pending N400. If you filed back in July 2016, you should be getting an interview date soon. That would also force them to make a decision of the I-751.

hmm... that's actually not very good news because Oakland Park FL office is one of the slowest in the whole country. They report 12-13 months for N400s, you may not get interviewed before next summer.

A little more detail would help of your marriage. I am looking for the following answers

1) What status did you enter the country with? Did you maintain that status?

2) What was your status at the time of the marriage?

2) Are the two of you from same ethnic background/place of birth/country or different?

 

There is a slight relation with your age difference, I personally dont think it should matter but USCIS does look for these kinds of things.

Once you answer these questions, the readers on this forum will be better equipped to help you.
