ROC

Please guys I need ur help. I filed i751 ROC in Dec 2016 and on 5th Nov 2017 I received RFE 

My questions

1) how do I send back the required document

2) Do I have to fill a new i751

3) or just put together the required document and with a cover letter

Send it through the mail, as outlined in the RFE letter along with the other instructions.  Get USPS tracking on it so that you can ensure it was delivered.

No.  Just send what they are asking for.

You don't have to include a cover letter, but you must include the original RFE letter sent to you along with the required document when mailing it back.

Please they asking for too much  does that mean I have to submit all the document? 

1 child cert ( we just had a first child on the 2 nov waiting for her birth cert)

2 evidence of join lease ( I already send this when we first filed )

 3 joint checking or saving ( we already sent this when we first filed )

4 evidence that u and ur spouse have estate health and financial planning

5 affidavit from third part.

 

1) I am waiting for out child birth cert, mean while I have 

 

2) Boarding pass of our trip together in may to my county.

3) joint health insurance

4) copy of our Drivers license showing bother address

5) 2016 texe return. ( though we already sent 2015 taxe return when I first filed.

4 evidence that u and ur spouse have estate health and financial planning - Did you send health insurance plan stating that you or your spouse as beneficiary?

5 affidavit from third part. - ask for friends who know you and your spouse and attest an affidavit support

If you have utility bills that is under your name and spouse name, like cellphone, electric, and cables send them as well.

The birth cert will take like 3 weeks (NY state law)

3) we only sent in cert. From bank showing we have joint savings

4) I made copy of our insurance card showing same I'd number and name

3) we only sent in cert. From bank showing we have joint savings - This makes sense you only sent the cert not the statements, USCIS wants to see the all the statements since day one of account opening to present with the transactions of in and out of money like groceries, movie date, utility bills. In short, co-mingling assets and liabilities that is under your name and spouse name.

4) I made copy of our insurance card showing same I'd number and name - Does the health insurance covers your spouse with your spouse name? If yes then photocopy the the card and the coverage then send it.

Please I really need help how to get this document

1) Evidence that you and your spouse have made estate, health and financial planning arrangement with each other:

A will

A trust

A durable power of attorney for health care or property or both

 

2)Affidavit from third parties who have knowledge of the bona fides of ur relationship.

Q: what should I write on this letter please any sample will go a long way helping me

 

3)Evidence of combined financial resources.

 

We have joint saving but we have a set back with my wife job and trying to meet up with life in NY we stopped using our saving for over a year now.

joint savings account, joint checking account, utility bills with both your names on it, tax return transcripts with both your names on it, joint health insurance, joint car payments, lease/mortgage with both your names on it to provide a few examples.

The third parties write the letter and sign it, you don't.  The persons you choose must be US citizens or LPRs.

Basically how they know you as a couple, when they met your spouse, how they have seen the two of you interact with each other as a married couple, if they were at your wedding, been at parties at your home or elsewhere with you as a couple, things like that.

Because from my rfe. Its says: An affidavit should be supported by documentary evidence and must be sworn to or affirmed by at least two people.

 

 

2) yesterday I was able to get verification of birth from the clinic were we had our baby (I don't have the birth certificate yet) and it has the following:

*Clinic letterhead with address and phone number

* my daughter full name 

* date of birth

* weight

*height

* wife full name

*my full name 

Signed and dated by the clinic (hospital)

Q. Would this be accepted as evidence of CHILD BORN???

Evidence of a child born is the official birth certificate.  If you send in the clinic letter, USCIS will only RFE you again for the birth certificate.

You helped me with my RFE ROC I received on the 2nd Nov 2017, I wanna let you know with your help and direction I resubmitted on the 1 dec 2107 and Got  APPROVED on dec 26 2017. 🤝🏽🤝🏽🤝🏽🕺🏿🕺🏿 I'm Dec 8 2016 fillier

The third party can get the letter notarized.

USCIS wants the official birth certificate...as I mentioned earlier, if you send in the letter from the clinic, USCIS will just RFE you again for the birth certificate.
