True, but the visa is still refused. The petition may be expired, but the visa was refused (by the embassy).

I think we're getting overly technical here for the OP. :P But visas are refused, petitions are denied/revoked/expire. The K-1 visa was refused and the I-129F is being sent back to expire. The result is the same for the OP.

The I-129F is being sent back to USCIS where it will expire. The existing K-1 path is gone. You need to either refile for a K-1, or get married and file for a CR-1. The latter is preferable.

 

You should review all information submitted and questions asked at the interview to understand why the case was denied. You can reach out to your local congressman as well to try to find out some details. There's no reason to wait for USCIS...it will come in a few months saying the I-129F expired and that's all. The other option is a FOIA request.

 

Personally, the lack of time spent together was probably the tipping point.  I don't know what else you sent as relationship evidence, but I highly suggest more time spent physically together...the ~11 days is quite little for an embassy as tough as Egypt.

im thinking to spend wiz  her two trips .. two weeks  in Georgia  and two  weeks in Egypt to let her meet  my family

then i will  refile for a K-1, or get married and file for a CR-1 

i prefer a K-1  cuz its  more faster than a CR-1

doubt you will ever know the issues for denial /  still waiting for informaiton about a July 2009 K1 case and why denied

i have writen and asked for the reasons several times as this costs so much to do the extra trips and marriage celebration and new applications

im thinking to spend wiz  her two trips .. two weeks  in Georgia  and two  weeks in Egypt to let her meet  my family

then i will  refile for a K-1, or get married and file for a CR-1

Hey Ezz,

Here's my honest opinion:

Ignore visits/trips bla bla .. save that money .. get married, live in Egypt for a year (at least) as a married couple .. that is if you intend to file for a CR-1, which is for couples who have been married for 1~2 years, to get approved on the spot.

K1 is dead like someone said. It used to be faster, but now with new changes it will be as equal to CR-1, or even worse (because now they know that ppl knew it was/used to be faster).

File for a FOIA before filing for a CR1 or any other immigration case to find out exactly why you were denied, to avoid it in future petitions.

You say the K1  is faster but look how long you have been waiting and now you would have to start all over again. If you spend more time getting together and then get married you may very well have a stronger case. Contrary to popular believe the K1 is not a better visa. The benefits of a CR1 far outweigh the K1. Yes, the K1 is faster but by only a few months. But then look your situation. It ended up not being faster.
