Fill out i-864 or i-864a - advice please!

Hi,

 

I have searched through the discussions on this forum, and I'm not finding a situation exactly like mine. Hoping someone can give advice from personal experience...

 

My husband, myself, and our two kids live outside of the USA currently. We will be moving in with my mom when we immigrate the USA, at which time we will both be quitting out jobs and not have income until we find new jobs in the USA. In this case, I need some sort of sponsor to financially sponsor my husband, the intending immigrant. My mom is single with no current dependents on her tax forms. I am claiming domicile in the USA with my drivers license, bank account, etc... all with her mailing address as my permanent mailing address. I will, of course, fill out the i-864. So, the question is does my mom fill out the i-864 as a joint sponsor or the i-864a as a household member, whose financially supporting the intending immigrant?

 

I think this is what we do: I fill out the i-864 and claim my household size as 4 (me, husband, two kids). My mom fills out i-864 as joint sponsor with household size as 2 (my mom, my husband). However, I'm not sure if our household is the five of us, since I use her address and we intend on living there. My tax forms have my current non-US address on them with my non-US income. I am, for legal purposes, temporarily living and working abroad, but still filing US taxes in the state which I maintain domicile.

9.27.17: Rec'd e-mail that i-130 approved! 

10.5.17: Case sent to dept. of state for processing.

10.11.17: NVC rec'd case.

10.20.17: Rec'd case number and invoice ID number from NVC over the phone.

10.21.17: Filled out choice of address and agent.

10.24.17: AOS bill opened and paid

10.31: IV bill opened and paid (called 10.26 to ask them to process AOS bill and DS-261)

11.1: Bank processed IV Bill

11.3 DS-260 form filled out online

11.8 NVC package sent!

11.13: NVC package arrives at NVC

11.14: Scan date!

11.16: Sent expedite request to NVC

11.22: Expedite approved by consulate

11.28: Rec'd e-mail from NVC that package was sent to consulate. CEAC tracker states: in transit. Case Complete at NVC
12.11 Rec'd e-mail from consulate that package arrived, together with Pkt 3 instructions.
1.10 Interview apt letter rec'd via e-mail! (scheduled medical appointment)
1.25 Interview in the morning. Was told approved on the spot and visa should arrive in the mail within ten days! Yay!
1.26 CEAC tracker says Visa Issued!
1.30 Visa arrived!

she will fill out the i864. you would have to be living with your mom, meaning your husband in his country and you living with your mom, to file the i864A

 

since you are living in your husband's country, you don't live with your mom currently

 

you fill out your i864 as sponsor, and household family size of 4, your mom files another i864 as your joint sponsor and a household of 2, as you mentioned

September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online
