Hello Vj,

I'm under process for my 2nd interview, can i add my children to it when am going for my 2nd interview, their names is already on the i130.. The children are step children for the petitioner. I need guide lines those who have gone through this process before.

My wife have enough to sponsor and also my children mother i don't know where she is ,am the one raising  my children before i meet my wife who is usc

they need separate applications ( i believe)

as said, if you are the parent, u need permission from other parent to take them out of Ghana

and, one thing that happened to another member is 

they said "why are u leaving your children behind ?"  and denied her 

don't know if you are a man or woman so this may not apply to u

as mentioned above unless the child was born after your i130 was submitted each child will need thier own i130 and they will have to wait about a year for it to be processed since they can not be added to yours.

and no there is no reason to expedite since both of you chose not to submit thier i130s and they will tell you that you can delay moving to the us so you can come as a group.

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Step children of US Citizens each need their own petition.  A petition is not an application.  Each intending immigrant will ALSO apply fora  visa, once the petition filed on their behalf, is approved.

Facts are cheap...knowing how to use them is precious...

this is a fine line as the applicant is considered the petitioner so what is the difference

is there a fee for the step child?

what is find is the step child still needs a I 130 (USCIS considers this an application and a petition

Not sure what you think is a fine line or to whom you are referring as "the applicant".  The term applicant is usually used to refer to the person applying for the visa -- that is, the beneficiary of an approved petition.  The person filing the petition is usually referred to as the petitioner.

 

But, bottom line -- there are no derivitives on IR petitions -- that means that nobody can be a part of anyone else's petition.  Everyone needs their own I-130 petition, with all the forms, fees, and required documents submitted to USCIS, then to NVC, and finally the Embassy for the visa interview.

The petitioner (US Citizen in this case) is only referred to as "applicant" on the obsolete G325a form, as it was used for multiple purposes.

Each step child of a US Citizen needs an approved petition.  All fees apply, unless the cases arrive at NVC together.  Then, the smallest fee of $120 can cover everybody's Affidavit of Support review.  Otherwise all the same fees apply to each person who will apply for an immigrant visa.
