K1 + owing taxes

Timeline

Yes. You must be up to date on your tax requirements. Part of the process your fiance will need to show tax returns from the last 3 years during his/her interview. This isn't submitted at the beginning - more towards the end, so if you are behind and have the financial means to get caught up, you have time to do so.

I think I've seen people present an IRS approved payment plan if you owe too much money to settle the debt in one payment.

 

Sorry, I do not think I was being clear. I, the petitioner (USC) do not owe any money in taxes. My foreign fiance (beneficiary) does. He used to live in the US as a student. I was asking if that will affect him? My taxes and finances are good to go on my end.

It could be a problem with "lack of moral character". When people are going through interviews in the US for citizenship or something else, owing taxes be a problem.  

 

I think he should try to solve the problem. I mean, as a student, there is no way you can owe too much money to the IRS, so he should settle the score.

He owes somewhere around the range of $2000 and some change I believe. We'll def work on paying that back. Definitely waaaayyyyyy before his citizenship test in the future lol. But was wondering if it could affect his K1 approval thats all.

As I said, it could speak to his moral character. And owing taxes is a crime, so that is a big problem. It is a crime no matter how much you owe. 

I think he need to get an accountant and figure out how to make a payment plan with the IRS.
