Howdy folks,

Great forum BTW and I was doing lots of searching but couldn't find anything specific. Please apologize if I missed it and just point me to the topic and I'll read up.

So I'm going through my checklists and what not for N-400 submission (from Perm Res) and I have a question regarding the child section.

 

1. Does anyone know (or has anyone done so) if you have to provide a copy of birth certificate for a biological child that is over 18yrs old and is NOT living in the US with them?

 

The form states to provide a birth certificate for your child but everything I've read kind of leans towards this being for a child "within the marriage" and under 18yrs old?
 

My daughter is on the form as it states ANY child, in our outside of the marriage regardless of where they are living.

Just wondering and double checking.

I guess it says about children in common. I sent my children's bc too but when looked online they never scanned them. I suppose they were not necessary.

I did not provide birth certificates for my adult children living in the UK. 

Read the checklist again carefully. The checklist says--

 

If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items: 

(4). Documents referring to you and your spouse:

a. Tax returns, bank accounts, leases, mortgages, or birth certificates of children; or
b. Internal Revenue Service (IRS)-certifed copies of the income tax forms that you both filed for the past 3 years; or

c. An IRS tax return transcript for the last 3 years. 

 

If the birth certificates do not "refer to you and your spouse", then they are not useful evidence for #4. Right? If a bank statement does not "refer to you and your spouse" then it is not evidence. Notice all of the suggested evidence for #4 is joined by "or", indicating you have a choice of items you wish to send showing you and the wife are still together.

I get the part you quoted and as for my wife and the docs we need I have them and understand that. but here was/is my issue.

 

Part 11. Information About Your Children
Item Number 1. Indicate your total number of children. Count all of your children, regardless of whether they are alive,
missing, deceased; born in other countries or in the United States; under 18 years of age or over 18 years of age; married
or unmarried; living with you or elsewhere; current stepchildren; legally adopted children; or children born when you
were not married.
 

So it's basically telling me to make sure I enter the details for my daughter, which is OK and I have done so.

 

In the section about what documents to bring to the interview it states..

C. Children and Support of Dependents. Bring evidence that all of the children listed on your Form N-400 are
your children. Such evidence may include:

(1) Birth certificates for all children you claim, or a court order naming you as the parent; or
(2) Final adoption certificates or decrees for all children you have legally adopted.
In addition, if you have dependent children living apart from you, bring evidence that you support each dependent
child and that you have complied with child support obligations. Bring photocopies of the court or government
order and evidence you have complied with the order if a court has ordered you to provide financial support for a
spouse, ex-spouse, or children. Such evidence may include:
(1) Canceled checks or money order receipts;
(2) A court or agency document showing child support payments;
(3) Evidence of wage garnishments; or
(4) A notarized letter from the parent or guardian who cares for your children.

 

So this is where I was getting it from. No real biggie I guess but it just seems "odd" that they would need me to provide a birth certificate when my daughter is over 18yrs old, not living here in the US, is not part of my application for citizenship and can also not become one just because I am (as she's over 18yrs old)

Yes I'm planning on Naturalizing, but at the research stage, and trying to find out what items I need to send in. I wasn't sure if I needed to send  copies of my childrens' birth certificates as they are living in the UK and are adults aged 25 and 30 respectively. I don't have their birth certificates and they cannot find them. I may have to get copies if they are needed.

Their birth certificates are not needed if they are not children in common.

Thank you for being so helpful. No they are my children from a previous relationship many years ago. So I'll just need to add them in the form but no need to send anything in?

Howdy and sorry for the late response,
I ended up getting a copy from the Oxford registry. Easy enough and they mailed it international for me. Better tg have and not need then need and not have. When I had my interview I wasn't even asked to product 1/2 the documents I had compiled, again better to have I suppose. All approved and my Ceremony is next week!

That's great news, congratulations. So you didn't send the birth certificates along with the application, just took them to the interview ?  My boys are always losing things, so they'll need them anyway at some point I'm sure.

 

I want to try and do it online if I can as my GC expires in September, and I've heard it maybe a tad quicker. I'll be going to England for 5-6 weeks in the summer to see my boys and grandbabies, so a little concerned about if I get called for an interview then, but I really need to see them.

Congratulations. When I naturalised, my officer didn't want to see any documents. Not even the originals that I got a letter saying to bring. She just got on with the interview/test. Weird how you prepare, then they can't be bothered with many of the details. Then there was the guy my wife and I shared the small waiting room with, all suited up, lawyered up and talking big who went after me. He didn't get approved. Makes you wonder.

Asking again to clarify this response: Did you send in the copy of this birth certificate when you sent in your N100 application?  Or did you not?  (I see that you did bring it in, but wanted to know if you sent it in as your original evidence?)

I did not provide any birth certificates for my adult children in England, not in the application or at the interview. Nor were they requested on the pre-interview letter saying what to bring. The originals I took to the interview were my wife's US birth certificate and proof that our previous marriages ended (divorce decree and death certificate). The same were submitted as photocopies in the application. The originals were not viewed at the interview, even though I offered them.
