I think I am almost ready to send off my AOS packet ( I am not applying for EAD or AP...taking my chances!). I have copied my cover letter below- can you let me know if I'm missing anything or if I've done anything incorrectly? THANK YOU SO MUCH :).

A few points.

1. Don't send them the marriage/cohabitation evidence in the AOS packet, they'll ask for that at interview. Its not necessary to send it with I-485.

2. A photocopy of the certified copy of marriage certificate is all that is needed, keep the original.

3. You might want to include 2005 and 2004 tax returns to be very safe. They're not required, but it can help avoid RFEs.

Thanks so much for the feedback. A couple of responses/questions:

1. Is it detrimental to send it? Will they just toss it? It's literally 2 pictures and 1 photocopied pages...I just think if they can see it now they might not require an interview.

2. No worries- I got extra certified marriage certificates...I have the original + 5 so I sent a certified one

3. The issue with the back returns is that my hubby was a graduate student in '04 (no income) and '05 ($10K in income)...one of the supplemental letters that I mentioned in my cover letter explains this. 2006 we're WELL above the poverty line and he's now fully employed (hence the employment letter and paystubs). SO....We don't have an '04 return to send and '05 was under the requirements anyway. What do you think?

I doubt its determental, its just unneccessary.

Sounds like you're well prepared! :)

You'll probably be OK, but you should be prepared to find a co-sponsor just in case. Sometimes USCIS just doesn't like affidavits that are in any way "out of the ordinary".

I think if you put in a letter explaining why he made so little in 2004 and 2005, that would be fine. I had the same issues (student in 2003 and 2004), so I did not include my 2004 or 2005 tax returns.

It's not detrimental, but the person who first reviews your packet is looking for what's supposed to be there - anything extra has a decent chance of getting tossed. They're pretty much just auditing your applications/petitions.

Yup, got NOA2 in that list (I refer to it by it's name in the I-485 application - Fiancee petition approval notice)

Thanks for the tip though!

Good to know you have been through it all in Cincinnati! It gives me hope!

Question though:

Why did you provide passport photos of BOTH you and your husband? Also, why did you provide G-325A for both of you? Also, your husband's birth certificate?? I don't recall reading requirements for those in the instructions.

Question though:

Why did you provide passport photos of BOTH you and your husband? Also, why did you provide G-325A for both of you? Also, your husband's birth certificate?? I don't recall reading requirements for those in the instructions.

Good question. There's no need to provide G325A for the USC or photos of the USC unless you're submitting a I-130 along with the petition (which as a K-1 you should be unless you didn't get married in the 90 day deadline).

Why did you provide passport photos of BOTH you and your husband? Also, why did you provide G-325A for both of you? Also, your husband's birth certificate?? I don't recall reading requirements for those in the instructions.

Good question. There's no need to provide G325A for the USC or photos of the USC unless you're submitting a I-130 along with the petition (which as a K-1 you should be unless you didn't get married in the 90 day deadline).

That is what the lawyer has sent with my application....and i didnt have any problem,no rfe...

They don't usually send RFEs for including too much stuff luckily, its just worth pointing out that the stuff was unneccessary because otherwise someone who is doing the paperwork themselves might read your post and get worried that there are extra forms that they need to fill out.
