I did not renewal my restraining order protection against my ex-husband and I did not have an I-485 interview yet.

Will be a problem if I don’t have an actualized restraing order?

It will not be a problem. The restraining  order you filed because you  feared  for you life,  but if you feel there  is no more danger then  there is   no reason to renew ok.

Hi All,

I went to my AOS interview yesterday and wanted to post my experience in case it is helpful to people.

I checked in,  and went to the waiting room. At the time I was scheduled, an officer came out and called my name. She then escorted me to her office. She swore me in and then asked me to sit down. Asked me if my lawyer was coming, and I said no and gave her a signed waiver form. I had already brought a waiver, but if you don't, they have a form for you to fill out and give to them. She asked for my ID, took a picture of my face, checked both my index finger thumbprints. Then she asked for my name, date of birth, parents names, country of citizenship, current address. Asked me a few questions like - are you a member of a terrorist organization, what clubs do you belong to, have you entered the US illegally, have you ever been out of status, have you voted in the US, have you represented yourself as a US  citizen, have you been part of a military anywhere. Then she asked if I was divorced, I said yes and gave her a copy of the divorce decree. I had already submitted it, but for some reason, it was not in the file. Then she let me know that I will need an updated medical examination since mine was more than a year ago. She then said that she can make a decision once my medical exam is received. That was it! It took about 7 minutes. I said that was quicker than I expected, and she said that my case was straightforward. She was friendly and respectful. She didn't ask me any questions about my marriage.

Hope this helps you all. Good luck!

Thanks for  Sharing! Congratulations 🍾🎉

All my communication goes to my lawyer because that is what I listed as my safe address to receive VAWA communication. I since t hen divorced and moved to my own place. But, I'm still electing to receive communication through my lawyer even though they have my updated address. The officer who interviewed me also said that they will send an RFE for updated medical to my lawyer's address.

To the survivors I want to say  that I am so sorry about what you went through. Do not blame yourself because abuse cannot be justtified.  Do not be ashamed, the abuse inflicted upon you cannot and should not dimish your worth, your life is precious. Rise above the abuse you experienced. Please step up and speak out against abuse.

@sandranjplease What qualifies one to file for an adjustment of status with their I-765 under VAWA? I am out of status, already divorced, and don't have any legal status, except for the prima facie I received. Can I file I-765, and I-485 whiles I await a decision to be made on my VAWA? or I will have to wait for VAWA to be approved first before I can adjust status. I hope my question is clear:unsure: Thank you

You can file I-485 at any time. Scroll a few pages back, we had many posts about this.

Thanks for your response, I see that, I am trying to find out who can actually file. Do I have to have been petitioned for something by my ex husband in the past? I will go back and check, I have seen a few post on it, but I don't know anyone's background which let them to file. I just need to make sure I qualify to file.

As long as your spouse is a us citizen you can file while your petition for Vawa is pending. You’re self petitioning so nothing is needed from your spouse. Except proof that he is a citizen which classified you as an immediate family
