If my ESTA was denied, should I apply I-601 (apc for Waiver of Grounds of Inadmissibility

I did some reading on CR1 process and I have seen a few comments saying that everyone who had Visa denied before and applying for CR1 also need to apply for I-601? (

Application for Waiver of Grounds of Inadmissibility )

I do not have denied VISA, but ESTA (not because I overstayed, or did some crime, but because I was travelling too often to see my fiance, without having fiance visa).. at the end it does not matter why.. 
anyway...I hope everything will be good and I was wondering what exactly I- 601 could do for me? could that help to my case with denied esta?

you are still able to file for a b1/b2 visa and if they deny you there they will give you a reason for the denial. whuch may be useful if you are going down the cr1 path since you would know what you need to address later. a denial for immigrant intent or lack of ties yo your hone country is a non issue when getting a cr1 since it's purpose is to move to the us.

Maybe I should try it, at least I could visit my husband, if approved. But I guess i would face another scrunity at the airport and I dont want to be send back after long flight again :D The thing is, when I was send back for the first time (for the reason above), the officer didnt give me any paper with specific reason. Now I am worried that at the consulate for CR1 interview, he would be looking into my "interview" questions and answers that I have at airport at CBP. Because of human factor- I was extremely stressed and exhousted after 15hrs without sleep and in the room with criminals and drug dealers.., I lied. I actually said total bs i dont even know why. Now I of course, I am prepared not to repeat mistake. However, i am worry he would compare the "interview" at the airport with what I say at CR1. if he has access to the airport interview?

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

that sucks... :-/ I didnt say truth how I met my husby. thats the most important question for them.:D And we didnt meet by a bad way, but at that time I didnt want to tell how. I hope I am not done because of it.

Well a lie is a lie, but perhaps if you explain what exactly was said we can give you advice. From what I gather you were traveling on the VWP program and made several trips. On the last one you were pulled into secondary and after an interview were sent back home for Im guessing immigrant intent. During the interview you state you lied. What was the lie? Was it one question about how you met your fiancee and you lied or was it a complex story you made up and they determined you were lying? 

 

If you dont want to talk about it- thats fine too. Then you will only get general advice which is what has been posted. The Officer will review your file and see any notes in it. It will depend what the inspecting Officer wrote and if the interviewing Officer catches it is different then what you submitted on the K application or are stating in the interview. You are not 100% done because of it. But if you explain what was asked and how you answered and what the truth is we can give you advice on how to handle the questions from the interviewing officer if it comes up.
