Just bought a house & applying for ROC

Hi everyone!  A little background info-

 

My husband moved here in 2014 on a K-1 visa. We were married 01/31/2015. Filed AOS without issue. Everything has been groovy! We just bought our first 'real' house on Friday (07/28/2017).

 

I'm worried about collecting evidence. At this point we dont have much in both of our names besides car insurance and bank accounts. We dont have the deed to the house yet (our attorney said it could take 3-4 weeks). The kicker is, his conditional green card expires next month! We need to file for ROC..yesterday. We have not been able to afford (as we were saving for a house) any vacations so there aren't any flight tickets in our names. No hotel rooms. We filed our taxes separately last year.

 

Are we doomed? I'm so anxious I feel like I'm giving myself an ulcer over this.

Dont stress out yourself too much. just submit whatever evidence you might have right now, USCIS will send RFE letter if they needed additional evidence. Better to file now before your 90 days window expires. Now make sure you will have everything that you can do to make it all official documents both under your name and spouse name so you can provide additional evidence if ever USCIS send you RFE.

03/01/19: Interview Date is on 04/08/19

04/08/19: Interview Day: Approved on the spot

04/09/19: We Scheduled your Oath Ceremony 

04/12/19: Oath Letter arrived in the mail

05/02/19: Oath Ceremony - OFFICIALLY U.S. CITIZEN AND END OF IMMIGRATION JOURNEY!

 

DS-11 - APPLICATION FOR US PASSPORT BOOK AND CARD

05/02/19: Submitted application thru USPS - Expedited
05/06/19: Received email, passport application is now traceable online thru Travel.State.gov website (https://passportstatus.state.gov/Search)

05/08/19: Received email, passport has been printed and it's on final processing
05/09/19: Received email, passport application has been finished processing with USPS tracking number and expected delivery is on 05/14/2019

05/10/19: Receive email from USPS informed Delivery - Expected Passport delivery is on 05/11/2019

05/11/19: Passport book received thru USPS Priority Mail

05/13/19: Passport card received

05/14/19: Naturalization Certificate back - END OF PASSPORT APPLICATION!

The deed may not be available yet, but what about mortgage paperwork. They don't really care about the home itself, only that you are both financially linked and sharing the responsibility.

Relationship:     First met 2015, Married since Oct 2016

2015 Apr - First met and started chatting online (he was in the US on a J-1 visa)

2015 Sep - J-1 visa expires (2 year home stay requirement)

2016 Feb - First trip to China (10 days): met friends and family, celebrated Spring Festival (Chinese New Year), lots of sightseeing (including seeing pandas), and lots of food

2016 Feb 06 - Purchase matching jade necklaces to mark engagement

2016 Jun/Jul - Second trip to China (10 days): lots more sightseeing, food, and time with friends/family

2016 Sep/Oct - Third trip to China (10 days) this time with my parents so that my parents could meet him and his mom, along with lots of sightseeing and food (i'm sure you've picked up on a trend by now :D)

2016 Oct - At the end of the time in China my parents, myself, and Xuan all traveled to Canada (7 days) so that we could get married, but unfortunately his mom couldn't come along with us.

2016 Oct 08 - Wedding day on top of Mount Washington on Vancouver Island, and it had just snowed the night before. (L)(L)

2017 Jan - Fourth trip to China (7 days), you guessed it: food, family, friends, spring festival, ...


The CR-1 Process:    NOA1 - PD 27 Dec 2016 (TSC)

2016 Dec 21 - Sent I-130 packet (along with G-1145 for e-notification) by USPS priority mail express (1-day), but missed the pick-up so it won't actually leave till the next day

2016 Dec 23 - Delivery confirmed by USPS

2017 Jan 03 - Payment drawn from bank account

2017 Jan 04 - Text and email confirming USCIS receipt of petition, assignment to Texas Service Center for processing and SRC case number

2017 Jan 09 - Received I-797c notice of action by mail (NOA1) with assigned priority date of 27 Dec 2016

2017 ??? ......... just waiting patiently for NOA2 (hopefully by April/May if they ever stop transferring cases from Nebraska)

Do you have a joint bank account? Family cell phone plan? Target card on both of your names or something similar? 

 

Did either of you had to fill in emergency information and life insurance information for your jobs?

 

They want to see commingle of finances and that you live together. Taking a holiday is not important here, that is bona fide relationship for K1. Here, what matters, is marriage. 

 

I think that you have more than you think and the worst that can happen is that you will get RFE. By that time, you will have the deed.

I believe even when you do separate ( but married) it shows both names and SSN.

- Bank accounts on both your names?

- 401K and/or life insurance
- Utility bills with both your names

- Internet with both your names

Yes, we filed separate but married. I did not realize that both of our SS #'s were on there!! Thank you!

I fully agree, I was just sort of lost as most examples of evidence include flight tickets and hotel accommodations. Thank you.

 

We do have both a joint checking and savings account. But no utilities in both names besides car insurance. No credit cards/store cards. We have LOADS of photos of both and us alone and with others, in many different locations. But I've heard many people say photos are not very important / great proof of a bona fide relationship.

We do have the contract, I didnt know if that would be acceptable. I guess the least I can do is try! Thank you!!
