Hello beautiful people! We filed a K1 visa earlier this year and got our approval (NOA2) last July 6, 2017. We're still waiting for our NVC number. My fiancee is currently pregnant and due to give birth 2nd week of October with our first baby. It's a blessing and we are very excited. However, we have a few predicaments that we badly need advice.

 

1. According to our I-797 notice, the visa is valid 7/7/17 until 11/6/2017. If she gives birth in the Philippines (2nd wk or 3rd wk of October), she won't be able to travel with our baby by November 6, 2017. Plus it is very unsafe for a newborn to travel that early. First problem, visa expires november 6, 2017.

 

2. Hopefully we get our NVC # this week, is it possible to expedite through NVC? or is it even worth it to go through the hassle since NVC mail it to the embassy in 3 days?

 

3. From obtaining the NVC# to the medical apt to scheduling an interview. Is it possible to fly to the US by September?

 

4. I am worried that by the time we get our interview apt to obtaining the visa, she won't be allowed by the airline. So what is the process of requesting an early interview? What are the chances of being granted an early interview?

 

Any additional advice will be greatly appreciated. Thank you

congratulations on the baby.

 

I hate to put it this way but.

being pregnant is a choice the two of you made and remaining pregnant is another choice the two of you made. your choices will not force the us government to hurry your case along since they were completely avoidable and any delay on there part will not severely hurt you it will only delay you.

It's possible, but you'd be lucky if it moved that fast. 

 

You schedule interviews online, so you basically have to get your NVC number, hope your medical doesn't have any issues and hope for an early appointment to open up. (basically someone would need to cancel) 

 

Like I said possible yes, but definitely don't get your hopes up.

Thank you. Being pregnant and remaining pregnant is the best choice we made. I don't know about you but there was no other options once we found out but to keep the baby. I respect your opinion but I am sure people would do the same if they were in my shoes.

Having the baby is a GREAT choice. You guys should be and I am sure you are, HAPPY. God has blessed you with a gift.  Ignore the negative comments. What you do is your business.

 

I wouldn't lose hope and would not stop trying to get an early or expedited appointment.  Keep calling NVC and get the MNL# because once you have that you can get started with paying your interview fee, completing the medical and also completing DS160. Don't schedule an appointment for a few days, but be looking on the schedule as much as you can. She can look and when she is sleeping you can watching for a cancellation and grab it.  I can remember a one or two years back we had very limited interview appointments and people couldn't get appointment because there were none to be had. They used a chrome extension to monitor the appointment page for changes. When the page changed then it would send a wake up to you and you could check in to the site and see what the change was. Most times it was an appointment that was open. Details below.

Restrictions to Changing Appointments

 

Please be reminded that even though nonimmigrant visa fees are valid for one calendar year, options to schedule an appointment are limited. The U.S. Embassy in Manila schedules hundreds of thousands of nonimmigrant visa appointments each year and must accommodate requests both for new appointments and for those applicants who need to reschedule their appointments for whatever reason. Applicants are only allowed to reschedule twice (not including the initial appointment) without penalty. If the second rescheduling attempt is canceled, an applicant will only be allowed to reschedule a new date after a waiting period of 90 days. Please plan your visa application accordingly to avoid problems securing an interview appointment.

1.  Your petition will not expire in November, the embassy will automatically extend it UP TO a year.  So relax on this.. it is not an issue to wait.

 

2.  There is info on getting your MNL# from NVC in the link below in my signature.

 

3.  Once you have the MNL # it is possible to get everything completed, right up to and including the interview, in a month.

 

4.  You schedule the interview date.. you can schedule an early date if there is one available. Pregnancy is not a reason to get an expedite.

As for traveling while pregnant, the rules vary by which airline, but this is a close guide to start with.

 

For the most part, the airline specific rules for traveling while pregnant don’t kick in until the third trimester in the 28th week, so before then you are basically left to your own good decision making and the guidance of your medical team.  However, once you hit the 28th week (or presumably look like you have hit the 28th week), some of the decision making about when and where to fly is out of your hands and in the hands of airline rules and policies.  US airlines typically do not require any documentation or have any travel restrictions until the last month of pregnancy, whereas many international airlines do require medical clearance starting at 28 weeks.

My now-ex came to the USA 11 years ago while 8 months pregnant.  We flew Northwest airlines at the time (now Delta).  Northwest's rule at the time was in the last month of pregnancy a doctor's clearance was required.  Her doctor wouldn't provide that, so we traveled with a letter from her doctor that had her expected due date noted and flew 31 days prior to that date.  We had no issues but we were concerned about her going into labor and discussed what to do a Labor and Delivery nurse prior to trip so we would be prepared.  Our son was born 10 days after she arrived in the US.

I just checked Delta airlines and their policy is that there are no restrictions on traveling while pregnant: http://www.delta.com/content/www/en_US/traveling-with-us/special-travel-needs/disabilities.html

Delta does not impose restrictions on flying for pregnant women, so a medical certificate is not required to travel. Keep in mind, however, that ticket change fees and penalties cannot be waived for pregnancy. If you're traveling after your eighth month, it's a good idea to check with your doctor to be sure travel is not restricted."
