K1 Visa after Marriage

Hello everyone!

 

If I may ask; is  there an expiration date for us to file AOS? we got married for a month now. But still we're not yet finish filling for AOS, however we're planning to file by the end of this month. I'm a little worried if I will get deported by chance?? Please help me clear my mind. Big Thanks!

You should be OK when you file at month end.  We waited over a month ourselves when filing because my wife had to request her birth certificate from the Philippines.

Thanks, but however do you think filing AOS got an expiration date? I just wanted to be sure about it. It's a little bit stressful thinking about it.

No, you will not be deported if you file AOS a little late. A fair number of people like myself have filed AOS late and there is no problem at all doing . Once you file for AOS the expired K1 will be forgiven because you are married na and have filed for AOS. So don't worry po.

Thank you so much. Makakahinga na ako. I am just over thinking about it. We need a lot of paperwork's to do; so it's a little late and I was really thinking I'll be deported.lol salamat po!

Too short

As long as you married within the 90 days, you can do AOS the same way at any time afterwards (years even...barring laws changing). However, once your I-94 expires (90 days after entry), you will be out of status and deportable. Once you file for AOS, you have authorized stay. If you're a few days out of status, the chances of being held is extremely low.

I see, we got married before 90 day's of entry. btw thanks you!

There is no filing date requirement for the AOS.  As Geowrian said many people file well after the 90 days, and even a year or two later.  The general rule-of-thumb though is to file as soon as you can after marriage to get the clock started.

Thank you guys, Visa journey helps a lot. I'm just thinking to much. Getting a Visa and being here gives me goosebumps everytime I think about requirements. I need to get over it.

Report your marriage to the Philippines Embassy? No, you do not need to and it is not a requirement at all to do it. But if you want a Philippine passport in your married name then yes you have to do the ROM, and keep in mind you have to do the ROM with the Consulate in the area y'all got married in. For example my asawa and I got married in NC and then a week later moved cross country to Los Angeles. So we had to do the ROM to the Philippine embassy in Washington DC. 

You can still travel back and forth to the Philippines no problem with your maiden name passport, just make sure you carry your marriage certificate with you, and your green card when you get it.

The only thing that could be worth noting is the validity of your medical (from overseas). It has to be within the 6 months validity when filing your AOS or else you might be asked to repeat the medical there in the US if I am not mistaken.

It's 1 year for AOS from a K-1, unless you have some followup items:

Oh thank you for that @geowrian! I don't know where I got the 6 month thing. I have been so worried that i will be doing my medical all over again. Thank you for pointing that out!!

It's 6 months for the K-1 visa.
