Timeline

I am only 19 and travel to Germany every couple of months to see my boyfriend so I am unemployed at this time. I just sent off the I-129. I am about to go back to Germany for 3 months. So as you can see I have to have a co-sponsor. I was wondering if there has been anyone who has used a co-sponsor for the affidavit of support. And if so was there any problems with it. I just want to make sure that that is ok and you don't get denied at the interview for just that reason.

I am using a co-sponser as well, but since i haven't been to the interview yet, I can't tell you if it will cause any problems or not. I really don't see why it would though. Co-sponorship is something the government allows for exactly this reason. I'm sure there have been many people here who have used a co-sponsor who can give a slightly more confident answer.

K1 Visa Journey:

Jan 12, 2007- I-129F Sent

Jan 17, 2007- I-129F has arrived at the NSC

Jan 24, 2007- NOA1 date

Jan 27, 2007- Check cashed by CSC

Jan 29, 2007- Paper NOA1 recieved (at permenant US address)

May 1, 2007- NOA2

May 16, 2007- At the NVC

May 18, 2007- Left NVC

May 30, 2007- Packet 3 arrives

May 31, 2007- Faxed Packet 3 stuff back

July 9, 2007- Interview at Vancouver

July 10, 2007- Visa recieved!

July 18, 2007- US entry

August 25, 2007- Wedding <3

No, there is generally no problem using a cosponsor for the K1.

However, the AOS phase is not cheap, and you'll have to prove income again at that time. Plus, setting up house with a new spouse would really be helped by a stable income. So you may want to start job hunting.

A related question that I've wondered about when I saw post relating to the need for co-sponsorship on K-1 visas....

Is co-sponsorship allowed during the AOS phase? If someone used a co-sponsor to prove financial responsibility to get the K-1 visa, once the marriage occurs and AOS is filed for, can that same co-sponsorship relationship be used to file for AOS?

I've just wondered about this when I saw posts on this subject....

ALOT of people have co-sponsers, that is not an issue for the visa.

Tracy is correct though, the AOS stage is expensive as is setting up a home together.

The same sponser can be used again at the AOS stage, I am using the same one and its no issue.

K-1 visa issued: 12/15/2006

This sounds so overwhelming. And scary. Im only at the NOA2 phase. I think i may need a co-sponsor as well. Im a bit nervous about asking for such a thing from someone. Feel like thats asking alot.

If your salary for this past year falls below the Poverty Guidlines (as reported by the DHHS) you will need to have a co-sponsor for your I-134. The poverty guidlines link is here. (scroll down a little to see the table).

For a household of two (you and your fiancee) you will need to have made more than $13,690. If you made less, you will definitely need a co-sponsor.

I agree w/ you, it does seem to be asking a lot. Many times people ask family or close friends to be co-sponsors.

Once your SO is here, the next step, the AOS process is also not cheap (especialy if by the time you will file, the proposed govt. fee increase goes into effect.) A more detailed financial support statement will be necessary, but I think the co-sponsorship can be used at that stage too.

my fiance got out of the air force at the beginning of this year and is unemployed right now, but hes doing job hunting cause i needs to earn some money before he starts to study in the winter semester. so im pretty sure he wont make enough money to sponsor me.

how much money does the co-sponsor have to make to be able to sponsor? does he have to sponsor me AND my fiance, and include himself too?

hope someone can help me out!

Take a look at the poverty guidelines your co-sponsor will need to make enough money for his/her house and YOU, not ur fiance, because this is till you get married. For AOS you will need another sponsor (can be the same sponsor from I-134) but have again to fill out a form for you.

i was already told to do that but its kinda confusing since i dont know which column applies to my fiances dad! the whole family is stil living togehter under the same roof. so do i just take the amount of people living together and add me to that number?

there are his mom and dad, his sister and his brother. his dad,sister and brother are working, his mom not.

so could someone tell me how to find out the right amount of people so that i know which collumn i have to look at?

definitaly need some advice with it! :help:

Some points of clarification and an answer:

- The K visas are non-immigrant visas. Immigrant (I-864) concepts do not apply, non-immigrant concepts apply.

- There is no such thing as 'co-sponsorship' for non-immigrant visas, there is only a sponsor. In the case of the K visas the sponsor usually is, but need not be, the sponsor, and will not be the sponsor if the petitioner does not qualify to sponsor.

- The non-petitioner sponsor for a K visa can be a Joint Sponsor (or a Household Member, is appropriate) for the adjustment of status if the petitioner remains financially unqualified. (Financially qualified or not, the petitioner is the Sponsor for an immigrant.)

- Are sister an brother supporting themselves or is either of them partially dependent on dad?

- Is dad claiming fiance, sister, or brother as a dependent on his income tax return?

i dont think that his kids are dependent on him, they earn their own money! so how can i find out if they are? do you have to have a document stating that they are? or does is just depend on who he claims on his tax returns?

sorry for asking you guys for help but i dont wont to bother my fiance with it cause hes having a hard time at the moment and i dont want to stress him with anything else right now!

It doesn't "just" depend on who he claims on his tax return, but anyone who is claimed as a dependent on his tax return should be shown as dependent on the affidavit of support. There could be exceptions, if circumstances have changed since the last tax return was filed, but if this is the case be prepared to document that the ex-dependent really is no longer dependent.

A moral judgement to make if a person is dependent but cannot or is not claimed as a dependent for tax purposes - some people might be tempted to 'overlook' the dependancy and hope they get away with it.

I was reading through here and I see now that we can use the same joint sponsor for the AOS process. But my question is - can we use the same supporting evidence if the timeframe is several months(from April to say, September)? I mean the same letter from employer, bank letter, tax returns, W2?

I am asking because this is quite a lot of papers we should get ready if we have to do it again after several months.
