Ten years ago I fell in love with and married a friend from the Philippines. I was only eighteen. I petitioned for him to come here and after two years, he did. He immediately went to into the US military and gained citizenship. We separated while he was away, but remained married until about two years ago (2015). Since then we have both remarried. My current husband is here from Mexico illegally and possibly facing deportation. My husband has been working with an immigration lawyer, and his lawyer told him that I can apply for him to stay here since we now have a child together and another on the way. But I havent told the lawyer that I have petitioned for someone in the past. Would it be a problem if i try to sponsor my current husband?

Immigrants Who Entered the U.S. Illegally (Without Inspection)

Now, what if the immigrant entered without having been inspected by an officer of Customs and Border Protection (CBP), for example by crossing the border in secret? In that case, the immigrant loses certain important procedural rights, like the ability to adjust status.

The immigrant will likely have no choice but to leave the United States and apply for an immigrant visa and green card at a U.S. consulate abroad. The consulate could refuse the visa because the immigrant is inadmissible, depending on how long the immigrant lived in the United States after the illegal entry. A waiver is available to applicants who can prove that denial of the immigrant visa would cause extreme hardship to a qualifying U.S. relative. Fortunately, as the immediate relative of a U.S. citizen, you can be proactive and apply for this waiver on a provisional basis, using Form I-601A, before leaving the United States. (Other applicants will have to leave the U.S. before applying for the waiver.)

It probably won't be an issue since it's from that long ago and there's no data that he came to the US just for a green card. However, I would make sure he's aware of the past marriage and what happened. He has an uphill battle ahead of him due to the entry without inspection and possible deportation.

Did he enter without inspection or on a visa?

Without inspection. He does however have a work permit to work here that his lawyer helped him get
